Hampstead neighborhood and yacht club owners ramp up battle over boating access

Many residents of the Olde Point neighborhood in Hampstead moved to the area to have boat access to the Intracoastal Waterway, but an ownership conflict is preventing that.

One of the residents is Ferrell Drewry, who took to social media to express his frustrations with the nearby Harbour Village Yacht Club (HVYC), a private organization. He created a GoFundMe to raise money for legal expenses so Olde Point lot owners can use HVYC property for boat landing and recreation.

"In the last few days, I've spoken to other Olde Point lot owners who are also frustrated by the high cost and/or lack of access to the HVYC property," he said on the GoFundMe page. "HVYC Rules and Regulations are overly restrictive, and the HVYC definition of a boat needs to be updated to include all paddle-powered craft. Olde Point lot owners have paid ramp fees for years, and those fees have continued to escalate without input or oversight by Olde Point lot owners."

He was unaware of the conflict when he was purchasing a home.

"Deeded water access was a feature that the selling real estate agent promoted in the listing," he said.

As of mid-January, Drewry said HVYC continues to stop them from unrestricted easement in the HVYC deed that was reserved for the benefit of Olde Point lot owners. The Olde Point Property Owners Association (OPPOA) filed a lawsuit against HVYC on behalf of the lot owners.

Bob Gessner, HVYC commodore, said a joint statement regarding the situation will be released soon. He said the club is not releasing additional information to the StarNews at this time because of confidentiality reasons.

"Some financial schedules were only provided to OPPOA as a result of the lawsuit, and those financial schedules show allocations of ramp fees to grounds and recreation when the HVYC (rules and regulations) specifically prohibit Olde Point lot owners from accessing the grounds," Drewry added.

In 2022, OPPOA President William Keith sent a letter to HVYC officials about removing "Right to Deny" uses and more under their rules. Additional talks, conversations and meetings took place during the year, in addition to letters being sent between representatives to organizations.

In a February 2022 letter, Gregory Leighton, then commodore of HVYC, said the rules and regulations are necessary for the safety of members and Olde Point residents nearby and to make access available year-round. He added that a majoring undertaking was planned to replace the ramp due to the ever-increasing numbers of Olde Point users.

"In addition, we continue to be a major lightning rod for property value increases for the residents of Olde Point," Leigton said.

He continued and said the retention of legal council by OPPOA requires the HVYC to defend their position and not change the rules.

"It is unfortunate that our 30-year history of providing safe, secure, ever improving boat launching facility for the members of the Olde Pointe Community has to come to this," Leighton said. "I remind you that without our leadership in the creation of the boat ramp and related docs it would be just a pile of sand benefiting no one all while respecting each of the homeowners' rights and following to the letter the spirit and rules set forth in the covenants."

According to a rules and regulations document for non-members, owners of property in Olde Point may apply for access to the HVYC boat ramp and parking lot. Fees are determined by the club's board on an annual basis.

Another part says HVYC has the right to deny the use of boat ramp and parking lot to any person at any time and is the final authority on the interpretation of the policy on non-member use of the boat ramp and parking lot.

It's a conflict that started many years ago, according to documents posted by Olde Point. One of the earliest was from the 2000s with mediation attempts coming from OPPOA regarding the right to deny use.

In 2017, a law firm representing HVYC sent a letter asking property owners to abide by the rules and regulations and for real estate agents selling homes or lots to not advertise the parking lot or boat ramp.

"The parking lot and boat ramp at Harbour Village Yacht Club are subject to the Declaration of Restrictive Covenants of Olde Point Development, which provides the Developer, 'its successors and assigns, the right to construct, lease, operate and manage any club, marina, or other like facility with associated amenities ... and to establish reasonable fees, rules, and regulations for use thereof," wrote Harrison B. Freedland of Craige & Fox, PLLC.

In a public message, Drewry also pointed out that HVYC said ownership of property within Olde Pointe does not by itself create an unqualified right of access to the boat ramp and parking lot.

"The emphasis on the last sentence is mine, because it looks to me from the HVYC deed that Olde Point lot owners do have an unqualified right of access to the boat ramp, parking lot, and the HVYC grounds," Drewry said on the Olde Point Facebook page.

He hopes OPPOA and HVYC can come to a mutual understanding that benefits everybody.

"So far, it looks like only the lawyers are winning by collecting fees," he said. "And yes, a lawsuit does make sense here since the parties cannot agree."

Paddle 4 Troops® is a 501c3 non-profit located in Surf City, NC. Our goal is to assist local military and their families that have a need that is not addressed by the military. Our two main fundraisers each year consist of our annual competitive and fun SUP race and our golf tournament that recognizes our heroes. Each of these events raise money to provide assistance for active, retired, or prior military and their families during their time of need.
