Two newly filed federal lawsuits claim that 10% sales commissions required by South Florida’s yacht broker industry are anticompetitive and violate antitrust laws.

The claims follow an October finding by a federal jury in Kansas City, Missouri, that the National Association of Realtors conspired with brokers to artificially inflate commissions paid to real estate brokers. The ruling, and a March 15 settlement by the Realtors, is expected to radically change how homes are sold in the United States.

Both lawsuits involving yacht brokers name as defendants the International Yacht Brokers Association, based in Fort Lauderdale, the Yacht Brokers Association of America, Boats Group LLC and YATCO LLC.

Also listed as defendants in both suits are a who’s who of South Florida-based yacht brokers, including Denison Yacht Sales, MarineMax Inc., Galati Yacht Sales Inc., Allied Marine Inc., Tournament Yacht Sales LLC and Northrop & Johnson Yacht Ships, among others.

Nearly all of the defendants are headquartered in South Florida.

The most recent suit, filed on March 22, proposes a class of plaintiffs that includes anyone who listed vessels on certain Multiple Listing Services using a listing agent or broker affiliated with one of the defendants and paid a buyer’s broker commission since March 22, 2020.

The lead plaintiff in the lawsuit is Kip Lamar Snell, identified as an Alabama resident. Snell entered into an agreement with Galati to sell a 41-foot Express Cruiser Sea Ray in July 2020 and ended up paying a $12,000 commission on the $120,000 sale price, the suit states. The lawsuit lists as defendants 15 brokers and six organizations that promote the yacht trade or operate Multiple Listing Services.

That lawsuit follows one filed on Feb. 29 that proposes a class of plaintiffs that includes anyone who paid a commission to a listing broker affiliated with the defendants since Feb. 19, 2020. It lists as defendants 11 brokers and five organizations that promote the yacht trade or operate Multiple Listing Services.

The lead plaintiff in that suit is Ya Mon Expeditions, a Wyoming company that paid a “substantial broker commission” when it sold a vessel in January 2023 while represented by Tournament Yacht Sales of Tequesta.

The most recent complaint accuses the trade associations of colluding with brokers to “enforce an anticompetitive restraint that requires (sellers of pre-owned yachts and boats) to pay a brokerage fee to the buyer’s broker and a total aggregate commission fee that is inflated as a condition for selling their yachts.”

The complaint states the typical commission is 10% and is shared between the seller’s broker and the buyer’s broker under terms spelled out in Central Listing Agreements provided by the brokers associations, including the International Yacht Brokers Association and the Yacht Brokers Association of America.

Only boat brokers are able to list boats and yachts on such Multiple Listing Services as YachtWorld.com, BoatTrader.com and Boats.com, and the Multiple Listing Services will not accept listings from owners who want to sell their vessels themselves, the lawsuit states.

Yacht owners are “severely disadvantaged” if they do not list their boats for sale on the listing services, while buyers suffer because their brokers are “financially incentivized” to show boats that will earn them standard “and inflated” commission rates of 4% to 5% through co-brokerage transactions, the complaint states.

None of the defendants contacted for this story responded to a request for comment, and no response has been filed yet in either case.

Robert Allen Jr., whose Miami-based law firm Robert Allen Law represents the International Yacht Brokers Association, did not respond to emails or return a phone call.

A woman who answered the phone at the International Yacht Brokers Association said, “We have no comment on that,” and hung up after a reporter asked for her name.

Of six brokers contacted for comment about the lawsuits, only Tournament Yacht Sales responded to emails. “No comment,” the company’s response stated.

Overall commissions have increased faster than the rate of inflation in recent years as the price of larger boats and yachts have increased, according to the lawsuit that lists Snell as lead plaintiff.

The result is that boat owners pay “hundreds of millions of dollars” in inflated commissions each year, the suit alleges.

Both lawsuits allege violations of the Sherman Antitrust Act that are upheld by “brokers who should be competing with one another but, instead, cooperate with each other to the detriment of pre-owned boat sellers.”

Some brokerages represent both buyers and sellers and retain the entire 10% commissions, the suits state.

The trade associations enforce rules requiring brokers to offer their boats through a listing service and to share commissions, the suits state, adding that they can impose significant penalties on members who do not comply with their rules.

Yacht purchasers are disadvantaged by the current system, the lawsuit alleges, because their agents would otherwise negotiate for their business by decreasing their commission rates.

But buyer brokers’ commissions have remained constant despite their diminishing role, the suits state. Many buyers today find boats they are interested in purchasing through online searches and enlist the services of a buyer’s broker only after identifying the yacht they want to buy, the suits claim.

The lawsuits seek an order declaring the commission structure to be illegal, a permanent injunction outlawing what they describe as anticompetitive conduct, plus damages and/or restitution, pre- and post-judgment interest, and attorneys’ fees.

Paul Geller, an attorney for one of two law firms representing the class that includes Snell, acknowledged “parallels between the allegations relating to commissions in the real estate and yacht markets.”

In the real estate matter, the National Association of Realtors on March 15 agreed to a $418 million proposed settlement that would free home sellers from paying commissions to brokers for both sellers and buyers.

After a jury ruled for the plaintiffs in the case against the National Association of Realtors in October, numerous lawsuits were filed across the country with similar allegations, including one in December against the Florida Association of Realtors and 16 brokerages.

“At bottom, the goals of (the suit against the yacht brokers) are similar: protecting consumers by challenging what we allege to be anti-competitive conduct,” Geller said by email. “We believe in the universal truth that consumers benefit by increased transparency and the competitive pricing that results from negotiated terms, including commissions.”

An Ohio woman whose toddler died after she left her alone for more than a week while she went on vacation was sentenced to life in prison without parole Monday, the Cuyahoga County prosecutor said.

Kristel Candelario, 32, pleaded guilty last month t o aggravated murder and endangering children in connection with the death of her 16-month-old daughter, Jailyn, last year.

Candelario left for vacation June 6 and left Jailyn alone. She visited Detroit and Puerto Rico, the prosecutor’s office said.

When she returned on June 16, she found Jailyn dead and called police, authorities said.

Jailyn died of starvation and severe dehydration due to pediatric neglect, Dr. Elizabeth Mooney, the deputy Cuyahoga County medical examiner, said in court Monday. The manner was ruled homicide.

The child was extremely dehydrated and emaciated, weighing 13 pounds, 7 pounds less than in her last doctor's visit less than two months before, Mooney said.

Mooney, who conducted the autopsy, called Jailyn's death "one of the most tragic and unfortunate cases I’ve had in my career thus far." She said the child could have suffered for possibly a week.

In a statement Monday, prosecutor Michael C. O’Malley called Jailyn “a beautiful baby girl who was taken from this world due to her mother’s unimaginable selfishness.”

Candelario told the court Monday that “every day I ask forgiveness from God and from my daughter Jailyn.”

She also asked forgiveness from her other daughter and from her parents.

Candelario’s attorney, Derek Smith, said that no one was trying to excuse her behavior but that Candelario was struggling emotionally and was overwhelmed as a single mother of two children.

Candelario had tried to harm herself earlier in 2023 and she had been placed on antidepressants, which she stopped taking without tapering down in dosage as required, which can cause side effects, Smith told the court. Candelario was "not thinking clearly," he said.

“I am not trying to justify my actions, but nobody knew how much I was suffering and what I was going through,” Candelario said through an interpreter.

Assistant Cuyahoga County Prosecutor Anna Faraglia told the court Monday that Candelario had left Jailyn alone for two days immediately before she left on vacation.

"The thought of this child dying every day while she's having fun — humanity can't stomach that," Faraglia said. "And those are the actions that need to be punished. She abandoned her daughter and left her for dead."

In sentencing Candelario, Cuyahoga County Common Pleas Judge Brendan Sheehan noted that the police and the medical professionals involved called it one of the most horrific cases they’d ever seen.

“It stunned people across this world, because it defies one of the basic human responsibilities,” Sheehan said. He called it “the ultimate act of betrayal.”

Sam Bankman-Fried faces the prospect of decades in prison as he is sentenced on Thursday — five months after being found guilty of stealing more than $8 billion of funds from customers of his now-bankrupt cryptocurrency exchange FTX.

The 32-year-old convicted fraudster will learn his fate at a Manhattan federal court hearing set for 9:30 a.m., capping an epic and swift fall from grace.

Sporting a now-infamous scruffy hairdo and uniform of a t-shirt and khaki shorts, Bankman-Fried had emerged as crypto’s friendly face in the US before his platform’s sudden November 2022 meltdown.

With his company worth $40 billion at its peak, the tech mogul flew around on private jets, showered politicians who he thought might be crypto friendly with millions in donations, and even palled around with celebrities at the Super Bowl.

But weeks after his platform’s collapse, he was arrested in the Bahamas and charged with swiping FTX user funds to plug a $8 billion debt at his failing hedge fund Alameda Research.

In November last year, a jury found that the ex crypto golden boy had looted the accounts of what prosecutors called “tens of thousands” of people — including in war-torn and unstable nations — who lost the nest eggs they entrusted to him.

He was also found guilty of defrauding FTX’s lenders by sending them phony balance sheets, and of lying to the company’s investors. He earned roughly $3 billion in ill-gotten gains from those schemes, prosecutors said.

Bankman-Fried has been in jail since August after US District Judge Lewis Kaplan revoked his bail after finding that he tampered with witnesses, including by leaking his ex-girlfriend Caroline Ellison’s diary to a journalist.

The feds asked Kaplan to sentence Bankman-Fried to 40-to-50 years in prison after his conviction on seven counts of fraud and conspiracy.

Lawyers for the disgraced crypto ace called for him to instead serve only 5¼ to 6½ years.

Bankman-Fried, who swapped out his unkempt look for a coiffed hairdo and suit and tie during the month-long-trial, took the stand in his own defense — which did not go well.

He  claimed more than 100 times that he could not “recall” details about his business — like repeatedly promising that his platform was “safe” — before being confronted with a mountain of evidence revealing that he said dozens of things he claimed not to remember.

The fallen crypto prince also gave no indication during his four-day stint on the stand that he felt any remorse for customers whose money vanished during FTX’s implosion.

“Even now Bankman-Fried refuses to admit what he did was wrong,” prosecutors wrote in a court filing earlier this month. “His life in recent years has been one of unmatched greed and hubris; of ambition and rationalization; and courting risk and gambling repeatedly with other people’s money.”

Three of his former business partners — including his ex Ellison, Alameda’s former CEO — pleaded guilty to their own fraud raps and flipped on him, testifying that the cocky math whiz set up a secret system allowing the hedge fund to have “backdoor” access to the exchange’s cash.

Bankman-Fried also used FTX customer funds to make more than $100 million in political contributions before the 2022 elections and to buy a ritzy $40 million Bahamian penthouse where he and his colleagues lived and worked, prosecutors said.

In total, the feds asked the judge to order Bankman-Fried to pay $11 billion in restitution — $8 billion to customers, $1.7 billion to investors and $1.3 billion to lenders — to make everyone whole.

According to his attorneys, the feds unfairly painted the MIT grad during the trial as a “supervillain” stealing from his customers to live the high life — while he was never in fact driven by greed.

The convicted fraudster was actually solely motivated by donating his riches to charitable causes, his lawyer Marc Mukasey claimed to the court.

Bankman-Fried cannot enjoy “fancy and expensive” things at all in fact because he suffers from a condition known as “anhedodia,” which is “characterized by a near-complete absence of enjoyment, motivation, and interest,” the lawyer argued.

The tech whiz’s mother, Stanford Law professor Barbara Fried, also urged the judge to give her son a lighter sentence because he has exhibited behavior consistent with people on the autism spectrum.

Bankman-Fried’s failure to read social cues will put him in “extreme danger” in prison, his mother warned.

“I genuinely fear for Sam’s life in the typical prison environment,” Fried wrote to the court.

Bankman-Fried’s lawyers also argued that his sentence should be lessened because, according to them, FTX’s customers and lenders will be able to recoup their losses through the company’s bankruptcy filing.

But federal prosecutors pushed back on that claim, saying in court papers that it’s “far from clear” that anyone will be made whole during that process.

A separate trial over Bankman-Fried’s alleged campaign finance violations that could have shed more light on his history of political donations — which include hefty contributions to Democrats like President Joe Biden and undisclosed “dark” payouts that benefitted top Republicans — was scuttled in December.

Prosecutors said that there was a “strong public interest” in sentencing Bankman-Fried as soon as possible given that the sentencing could include a massive forfeiture set aside for victims.

The feds had also yet to secure permission from Bahamian officials that they needed to pursue the campaign finance charges under an extradition deal, US prosecutors said.

Bankman-Fried had also been hit with an explosive charge of bribing at least one Chinese official $40 million to help unfreeze a trading account that he owned, but that allegation also never made it to trial.

He has continued to maintain that he did not commit any crimes, and plans to appeal his conviction.

White former officers get sentences of 10 to 40 years in torture of 2 Black men in Mississippi

J ACKSON, Miss. (AP) — A federal judge on Thursday finished handing down prison terms of about 10 to 40 years to six white former Mississippi law enforcement officers who pleaded guilty to breaking into a home without a warrant and torturing two Black men in an hourslong attack that included beatings, repeated uses of stun guns and assaults with a sex toy before one of the victims was shot in the mouth.

U.S. District Judge Tom Lee called the culprits' actions “egregious and despicable" and gave sentences near the top of federal guidelines to five of the six men who attacked Michael Corey Jenkins and Eddie Terrell Parker in January 2023.

The case drew condemnation from top law enforcement officials in the country, including Attorney General Merrick Garland. In its grisly details, local residents saw echoes of Mississippi’s history of racist atrocities by people in authority. The difference this time is that those who abused their power paid a steep price for their crimes, the victims' attorneys said.

“The depravity of the crimes committed by these defendants cannot be overstated,” Garland said Thursday.

Brett McAlpin, 53, who was the fourth highest-ranking officer in the Rankin County Sheriff's Office, received a sentence of about 27 years on Thursday. McAlpin nodded to his family in the courtroom. He offered an apology before he was sentenced but did not look at the victims as he spoke.

“This was all wrong, very wrong. It’s not how people should treat each other and even more so, it’s not how law enforcement should treat people,” McAlpin said. “I’m really sorry for being a part of something that made law enforcement look so bad.”

The only defendant who didn't receive a prison term at the top of the sentencing guidelines was Joshua Hartfield, 32, a former Richland police officer who did not work in a sheriff’s department with the others and was not a member of a “Goon Squad.” He was the last of the six former officers sentenced over three days this week, months after they all pleaded guilty.

Before giving Hartfield a 10-year sentence Thursday, Lee said Hartfield did not have a history of using excessive force and was roped into the brutal episode by one of the former deputies, Christian Dedmon. Lee said, however, that Hartfield failed to intervene in the violence and participated in a cover-up.

Lee sentenced Dedmon, 29, to 40 years and Daniel Opdyke, 28, to 17.5 years on Wednesday . He gave about 20 years to Hunter Elward, 31, and 17.5 years to Jeffrey Middleton, 46, on Tuesday .

Arguing for a lengthy sentence, federal prosecutor Christopher Perras said McAlpin was not technically a member of the Goon Squad but “molded the men into the goons they became.”

Parker told investigators that McAlpin functioned like a “mafia don" as he instructed the officers throughout the evening. Prosecutors said other deputies often tried to impress McAlpin, and Opdyke's attorney said Wednesday that his client saw McAlpin as a father figure.

The younger deputies tried to wrap their heads around how they had started off “wanting to be good law enforcement officers and turned into monsters,” Perras said Thursday.

“How did these deputies learn to treat another human being this way? Your honor, the answer is sitting right there," Perras said, pointing at McAlpin.

In March 2023, months before federal prosecutors announced charges in August, an investigation by The Associated Press linked some of the deputies to at least four violent encounters with Black men since 2019 that left two dead and another with lasting injuries.

The officers invented false charges against the victims, planting a gun and drugs at the scene of their crime, and stuck to their cover story for months until finally admitting that they tortured Jenkins and Parker. Elward admitted to shoving a gun into Jenkins’ mouth and firing it in what federal prosecutors said was meant to be a “mock execution.”

The terror began Jan. 24, 2023, with a racist call for extrajudicial violence when a white person complained to McAlpin that two Black men were staying with a white woman at a house in Braxton. McAlpin told Dedmon, who texted a group of white deputies asking if they were “available for a mission.”

“No bad mugshots,” Dedmon texted — a green light, according to prosecutors, to use excessive force on parts of the body that wouldn’t appear in a booking photo.

Dedmon also brought Hartfield, who was instructed to cover the back door of the property during their illegal entry.

Once inside, the officers mocked the victims with racial slurs and shocked them with stun guns. They handcuffed them and poured milk, alcohol and chocolate syrup over their faces. Dedmon and Opdyke assaulted them with a sex toy. They forced them to strip naked and shower together to conceal the mess.

After Elward shot Jenkins in the mouth, lacerating his tongue and breaking his jaw, they devised a coverup. The deputies agreed to plant drugs, and false charges stood against Jenkins and Parker for months.

McAlpin and Middleton, the oldest in the group, threatened to kill other officers if they spoke up, prosecutors said. In court Thursday, McAlpin's attorney Aafram Sellers said only Middleton threatened to kill them.

Sellers also questioned a probation officer about details submitted to the judge. When federal investigators interviewed the neighbor who called McAlpin, that person reported seeing “trashy” people at the house who were both white and Black, Sellers said. That called into question whether the episode started on the basis of race, he argued.

Federal prosecutors said the neighbor referred to people at the home as “those people” and “thugs.” The information included in the charging documents, which the officers did not dispute when they pleaded guilty, revealed some of them used racial taunts and epithets throughout the episode.

Majority-white Rankin County is just east of Jackson, home to one of the highest percentages of Black residents of any major U.S. city. The officers shouted at Jenkins and Parker to “stay out of Rankin County and go back to Jackson or ‘their side’ of the Pearl River,” court documents say.

Attorneys for several of the deputies said their clients became ensnared in a culture of corruption that was encouraged by leaders in the sheriff's office.

Rankin County Sheriff Bryan Bailey revealed no details about his deputies’ actions when he announced they had been fired last June. After they pleaded guilty in August, Bailey said the officers had gone rogue and promised changes. Jenkins and Parker called for his resignation and filed a $400 million civil lawsuit against the department.

Bailey, who was reelected without opposition in November, said in a statement Thursday that he is “committed to the betterment of this county” and will work “with the honest, hard-working men and women currently with this department" to make Rankin County safer.

In a statement read by his attorney Thursday, Jenkins said he “felt like a slave” and was “left to die like a dog.”

“If those who are in charge of the Rankin County Sheriff’s Office can participate in these kinds of torture, God help us all," Jenkins said. “And God help Rankin County.”
