Multihull superyachts are becoming a more common sight. High profile support yachts like Hodor , the 67m Catermaran built at Astilleros Armón, as a ​​support vessel to Lonian, is one such eye-catching addition to the fleet. The benefits of multihulls are many and varied. Their hydrodynamics and efficiency lead to lower fuel consumption, and the onboard usable space is immense when compared to the LOA. One of the true pioneers of luxury multihulls is Dave Pachoud, from Pachoud Yachts and Voodoo Yachts. I caught up with Dave, and his son and business partner Mitch Pachoud, onboard their 2020 launch, the 27m Rua Moana . 

Starting out building multihulls for his family to use over 30 years ago, Dave Pachoud and the team at Pachoud Yachts have quietly innovated the sector in South Pacific. One of the foundational innovations that they have pioneered is the use of a foil assist to increase the efficiency and high-speed range of their multihulls. As the fleet strives for a more sustainable future, fuel efficiency is a vital factor. The simple metric of less fuel burnt = less carbon released is simplistic, but nonetheless important. An imminently scalable system, their approach shows that there is plenty of room for innovation in hull design.  

“The good thing about the foiling catamarans that we have developed,” explains Mitch Pachoud, “is that we have a platform that affords us the ability to look at the system at a fundamental level. We challenged how it operates; how much power is really required to move this boat? That then flows onto the environmental benefits." 

One of the guiding principles for their custom and semi-custom multihulls is giving owners and operators the freedom to navigate the South Pacific. One of these owners is Craig Armstrong, of Rua Moana , who has owned four of Pachoud’s catamarans. He recounted to me that on one of the foil assisted models, they completed the crossing from Opua, in the Bay of Islands at the top of the North Island of New Zealand, to New Caledonia in just 27 hours. This journey of 900 nautical miles was made possible with relatively little fuel, because of the efficiency of the foil assist system.

“We are not fully flying like the Team New Zealand folks are, we are foil assisted,” explains Dave Pachoud, “we first developed the system 10 years ago, and have refined it with each boat since then. We created it to be a practical South Pacific cruiser. An owner or captain can move quickly from New Zealand to Australia or Fiji at high speed, and efficiently. That is what drove the 1300 mile range. To achieve this we need it to be a very stable platform with simple drive lines with immersed propellers. When you start moving at over 40kts with immersed propellers, you have got to look at every part of your driveline, refining the struts and rudders. Everything needs to be perfectly streamlined.” Says Pachoud.

The foil assist involves integrated foils at midships that lift the majority of the hulls out of the water, similar to a planning vessel, but with significantly less fuel consumption and more stability. The decreased drag then allows much higher speeds relative to power output. Foiling boats are, of course, nothing new. Commercial applications are many and varied, but the private yacht sector has been relatively slow to adopt. As Dave Pachoud explains, the system fundamentally changes the way a passage is approached.  “A lot of foils have been added to the boat after the fact, we wanted to design a hull that will have comfortable ride characteristics and efficiency while taking the load on the foils."

"We have really turned the whole passage making in the South Pacific on its head. The equation of carrying excessive amounts of fuel, and steaming at 8 knots to make the journey is not the only way to do it.” Says Dave Pachoud. 

“What this creates is a different lifestyle,” adds Mitch Pachoud, “we want owners to be comfortable and interested in taking on these passages by themselves, or remaining on board with the crew. With the advancements in weather forecasting, picking a two or three-day weather window can be done with a high level of accuracy. Combined with the ability to travel at high speed over long distances this makes the passages achievable in good comfortable weather for the entire journey.” 

Hi-performance foils are synonymous with hi-quality composite work. Carbon fibre specifically underpins the performance. Early adopters of the technology, Dave Pachoud reflects on the New Zealand pioneers that trailblazed its use in the marine sector. “A lot of the composite innovation in New Zealand started way back with guys like High Modulus (Hi-Mod). I brought my first material from Hi-Mod back in 1987 and engineered it into one of my first race boats. Guys like Richard Honey and Brian Jones trained a lot of people and really led the industry through those early innovations. Just look at KZ7 and early America’s Cup yachts. They left a legacy that is still strong in the New Zealand marine industry.”

The green credential of burning less fuel needs little explanation, but with alternative propulsion and energy generation the next big step for the industry, we discuss the implications for foil assisted systems. “We have looked at electrification,” concludes Dave Pachoud, “but to date, the equation has not stacked up. The better metric is hydrogen, which is going to be the game-changer. But the simple fact is, battery-electric has just never come down of the right side of the equation.” 

How then would hydrogen fit into this equation? The energy density issues have affected many hopeful superyacht designs, and may yet hamper its widespread adoption. Often hydrogen systems are added to conventional hull designs with their inbuilt efficiencies, and this is where Pachoud Yachts may hold an advantage. “We would not redesign the whole boat for hydrogen,” says Mitch Pachoud, “we just need to look at how much range we could get from the hydrogen storage. It does not matter so much ultimately what propulsion system and fuel we put on top of it, the fact is that we have a highly efficient starting point that will get the most out of it.”

Fast and efficient 1300 mile crossings have obvious Mediterranean applications. And, as Mitch Pachoud explains, that range can be increased. The cross-crossing rooster's tails from overpowered yachts burning 100s of litres of fuel an hour at 30 knots may have been a badge of honour a generation ago, but will not be looked on kindly in hindsight. Foil assisted yachts like those pioneered for the South Pacific by Pachoud Yachts could be part of a more efficient and ultimately greener future for the fleet worldwide. 

"This technology is highly scalable for larger yachts, and we would love to take on larger projects," concludes Mitch Pachoud. With the progression from a passion project for his family, to fully custom superyachts, the team at Pachoud Yachts have refined their innovations and is ready for the next big challenge. For an industry grappling with how to reconceive its footprint and the way it operates, the Kiwis, once again seem to have been quietly innovating and showing a way forward.

New boat stack refloated

By Graham Skellern A half-built boat stack that lay idle at Tauranga's Sulphur Point for more than a year is being brought back to life by a leading Irish developer. Aidan Harrison's Channor NZ has bought the 1.8ha Cross Rd site formerly owned by Pachoud Tauranga Trust and is continuing the $20 million Fort Nautilus boatstack and apartments development. The drystack, storing up to 200 5-12m boats on five levels, is expected to be operating within two months and the 12 apartments over four storeys are due to be completed by September. The development, which includes dredging an 80m long, 6m deep canal for boat access to the harbour, ground to a halt last April when the trading company Pachoud Motor Yachts went in to liquidation, owing nearly $7m. The steel framing of the boatstack had been erected and the southern wall next to the railway line has now been built. Half the steel framing for the apartment complex is also standing and the remainder will be in place within two weeks. "We've got it up and rolling and everything is going smoothly," said project spokesman John Keogh. "We are keen to make it work and we will go right through to completion. "It's something different for Aidan ... a boating theme and apartments instead of the commercial buildings he does in Dublin. All his financing is coming from Ireland," he said. Mr Keogh, who lives in Wellington, told his cousin about the proposed development, and Mr Harrison visited Tauranga last May to take a look. Two months later he bought the prime waterfront site from Crossroads Developments who had secured it from the liquidator. For the past 10 years, Mr Harrison has developed the Blanchardstown Corporate Park next to the Dublin ring road. His company, Channor Limited, has attracted 50 companies from Ireland, England, central Europe and North America including eBay and the upmarket business park includes a creche, 200-seat restaurant, mini-supermarket and a privately-owned staff bus service. Mr Harrison has bought three jetboats in New Zealand, joined the national jet boating association and is building a sprinting course in Ireland. Dave Pachoud, who moved his boatbuilding business from Rotorua to Tauranga in 2001, had a plan to establish a wide ranging Marine Park at Sulphur Point. Mr Harrison is re-living that dream. The boatstack, 72m long and 44m wide, has a full valet service - the boaties will simply stroll to the dockside and hop in. Their boats will have been taken from the storage racks and placed on the water by a forklift. The staff will have also serviced them and when the boaties return from their day's fishing and cruising the staff are back in action washing the hulls, flushing the engines and storing the boats. Nearly 80 people had paid a deposit for a berth in the boatstack and they have the option of staying on or getting their money back. The lease for an average 6m berth has risen from $4000 to $5500 a year. The apartments facing the water are between 200-250 sq m in size and the price for the four biggest will be more than $2 million. The apartments, which have a common lap pool, spa, sauna and gym, will not be sold until they are completed. Another building on the site is fully leased by 12 tenants including a cafe. Mr Pachoud employed up to 120 people to build his luxury motor yachts but the staff had dwindled to 15 when his company crashed last year. The staff have since been paid 49c in the dollar for holiday pay and wages owing - and that was the only payout to 120 creditors. The liquidator recovered only $80,000 from selling plant and equipment. Athol Ryan, the agent for the liquidator, said Pachould Motor Yachts had trading losses totalling $4.1m in the two years before it went under. He said there were no dividends for the unsecured creditors who were owed more than $1m but the biggest losers were the shareholders who pumped in $5.3m.

Moscow City Court rules to liquidate Moscow Helsinki Group

The Moscow City Court has ruled to liquidate the Moscow Helsinki Group, the oldest human rights organisation in Russia, Novaya-Europe correspondent present at the court hearing reports. It took one court hearing to come to a ruling on the liquidation lawsuit.

The basis for the liquidation demand were the results of an unplanned inspection of the organisation which was carried out on request from a Prosecutor’s Office in November. The Justice Ministry claimed that representatives of the Moscow human rights organisation took part in conferences in other regions of the country, as in not in Moscow, which allegedly violated “the confines of territorial activity”.

“The examples of such activities are: acting as observers during high-profile court hearings, appeals to regional authorities, as well as taking part in events organised by the organisation’s partners (including those online),” the Moscow Helsinki Group’s website reads.

For example, the Justice Ministry of Russia claims that in 2020 members of the organisation acted as observers during a court hearing on the case of prison torture in the city of Yaroslavl, were present at several court hearings held in the city of Podolsk on the case of ex-head of the Serpukhov district of the Moscow region Alexander Shestun, and signed a joint letter from human rights defenders addressed to the St. Petersburg governor Alexander Beglov asking to cancel the ban on one-person pickets in the city. In total, the Justice Ministry’s lawsuit contains 11 episodes of “violations”.

During the hearing, representatives of the defendant filed a motion to recognise the “unplanned inspection” as illegal but the court denied the motion. The court also rejected all of the defendant’s witnesses.

Representatives of the Justice Ministry claimed that the human rights organisation failed to provide the full set of documents required during the inspection and that the organisation’s charter does not meet the current legal requirements. The ministry found the violations “unfixable the legal way” and asked for the Moscow Helsinki Group to be liquidated and its work to be banned on the territory of Russia.

The Moscow Helsinki Group has been active in Russia since May 1976. The founder and the first president of the group was Soviet physicist, human rights defender Yury Orlov. Starting from 1996 up to the end of her life (2018), human rights defender Ludmila Alexeeva acted as the chairwoman of the group.

The Observatory for the Protection of Human Rights Defenders, a partnership of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in the Russian Federation.

Description of the situation:

The Observatory has been informed about the liquidation of the non-governmental organisation Moscow Helsinki Group (MHG). Founded in 1976, MHG is the oldest Russian human rights organisation established in the country. MHG provides legal and other types of assistance to Russian citizens and residents, disseminates information about human rights violations, monitors high-profile trials, and promotes human rights and fundamental freedoms.

On January 25, 2023, the Moscow City Court ordered the liquidation of MHG for alleged violation of the Federal Law "On Public Associations", following a lawsuit filed by the Russian Ministry of Justice (MoJ). The court alleged that, as an organisation registered in Moscow, MHG’s activities should have been conducted only in this city, but instead its members participated in conferences and monitored court proceedings in other regions of Russia. Judge Kazakov rejected all of the organisation’s motions to call witnesses and enclose documents in the case file. While the trial lasted five hours, the subsequent deliberation and decision to liquidate the organisation were made in 20 minutes.

In November 2022, officers of the MoJ conducted an unscheduled inspection in the office of MHG in Moscow, after which the Main Department of the MoJ filed a lawsuit on December 14, 2022, before the Moscow City Court requesting the liquidation of the organisation, as well as a ban on all its activities in Russia.

MHG leadership received an official notification about the lawsuit on December 20, 2022, which stated that the grounds for the liquidation were the alleged participation of MHG members in activities outside the region in which it is registered, that is, Moscow. Among such activities, the MoJ mentioned the following ones: participating in conferences and trial observations; addressing regional authorities; and participating in offline and online events organised by MHG’s regional partners in areas other than Moscow. Particularly, the MoJ found 11 violations of "territoriality", including a trial in Yaroslavl in 2020 in a high-profile case of torture in a penal colony, surveillance of the widely publicised "Ingush case", and a request to St Petersburg governor Alexander Beglov to lift the ban on solitary demonstrations in the city. The MoJ alleged that all these activities implemented by MHG outside Moscow were illegal and further argued in its lawsuit that there were "inconsistencies in the statutes of the MHG”.

The Observatory recalls that the legislation governing NGOs’ activities in Russia is draconian and falls short of international standards on freedom of association. The liquidation of MHG is an unnecessary and disproportionate penalty for the violations allegedly committed by the organisation, and violates Article 22 of the International Covenant on Civil and Political Rights on the right to freedom of association.

Furthermore, according to international standards on freedom of association, inspections of NGOs are only legitimate if they are justified, for instance, where there are reasonable grounds to suspect that serious breaches of the law have occurred. The unscheduled inspection of the MHG had no such justification and violated international standards on freedom of association.

The Observatory further notes that since 2012, the Russian authorities have adopted a series of progressively tightening anti “Foreign Agents” laws to silence all dissenting voices, including NGOs, human rights defenders, independent journalists, media outlets or any person or group considered to be under “foreign influence”. For NGOs, it is virtually impossible to comply with all requirements under the “Foreign Agents” legislation which results in disproportionate, unnecessary and illegitimate restrictions on their right to freedom of association, including liquidation.

MHG was committed to complying with the requirements of the above-mentioned legislation regulating NGOs, for instance, by refusing to receive any foreign funding after the adoption of the “Foreign Agents” legislation in 2012 . Nonetheless, the MoJ found a pretext to liquidate the organisation under the law “On Public Associations”.

The Observatory strongly condemns the dissolution of MHG, which seems to be only aimed at sanctioning it for its legitimate human rights activities and its exercise of the rights to freedom of association, assembly and expression. The closure of Russia’s oldest human rights organisation comes amid the Kremlin’s brutal crackdown on Russian civil society and human rights defenders.

The Observatory recalls that in December 2022, two other prominent human rights organisations in Russia, Human Rights Center Memorial and International Memorial, were arbitrarily liquidated .

The Observatory urges the Russian authorities to immediately repeal this decision and put an end to any act of harassment against MHG, as well as against all human rights organisations in the country, including Human Rights Center Memorial and International Memorial.

The Observatory further urges the Russian authorities to ensure in all circumstances that human rights defenders and organisations in the country are able to carry out their legitimate activities without any hindrance and fear of reprisals, and to guarantee in all circumstances the rights to freedom of expression, assembly and association in the country, in accordance with Articles 19, 21 and 22 of International Covenant on Civil and Political Rights, respectively.

Actions requested:

Please write to the authorities of Russia, urging them to:

–  Immediately repeal the decision to dissolve Moscow Helsinki Group;

–  Put an end to all acts of harassment, including at the judicial level, against Moscow Helsinki Group, its members, as well as against all human rights organisations and defenders in Russia, and ensure in all circumstances that they are able to carry out their legitimate activities without any hindrance and fear of reprisals;

–  Guarantee, in all circumstances, the rights to freedom of expression, assembly and association, as enshrined in international human right law, and particularly in Articles 19, 21 and 22 of the International Covenant on Civil and Political Rights.
