By virtue of the Court’s Order dated June 10, 2024 [ECF No. 43] issued by the United States District Court for the Southern District of Florida, directing the U.S. Marshal to sell the vessel M/V SUMMER 69 and allow Plaintiff to credit bid its judgment, notice is hereby given that I will sell by public auction to the highest bidder on August 13, 2024 at 12:00 p.m., Eastern Standard Time, at the U.S. Federal Building and Courthouse, 299 East Broward Boulevard, Fort Lauderdale, Florida 33301 outside of the main lobby on the first floor of the U.S. Courthouse steps, the following property: M/V SUMMER 69, a 2003 130’ Westport Motor Yacht, Official No. 1143060, along with her boats, engines, boilers, tackle, equipment, apparel, furnishings, freights, and appurtenances, etc. The successful bidder shall be required to pay a deposit of 10% at the time and place of the sale and shall pay the remining 90% within seven (7) days thereafter. All payments shall be in the form of cash, certified check, or cashier’s check. Failure to pay the balance in accordance with the terms of the sale will result in the forfeiture of the monies deposited and the property will be re-offered for sale. The M/V SUMMER 69 shall be sold AS IS, WHERE IS, free and clear of all liens and encumbrances, and pre-existing claims on the property, whether recorded or otherwise. The sale and post-sale process shall comply with all laws of the U.S., including the citizenship requirements of Section 2 of the Shipping Act of 1916 as amended, 46 U.S.C. App. 802, and Local Admiralty Rule E(17). The sale is subject to confirmation by the Court.

Offers are accumulated weekly through each Monday at 4:00 PM ET. In the event a particular Monday is a Federal Holiday, the deadline is extended an additional 24 hours. The high offer on a particular vessel is submitted to the Seller for consideration the following business day. The Seller, at its sole option, may accept or reject with or without a counter offer. Responses typically occur within 48 hours, no response constitutes a rejection of theoffer.

Upon notification of acceptance of an offer (either verbal or electronic), successful Bidder has 1 business day to deposit into National Liquidators escrow account, the greater of 10% of Gross Offer or $1,000.

Upon notification of acceptance of an offer (either verbal or electronic), successful Bidder has 5 business days to complete any and all conditions listed above in the “Conditions Of Offer”. In any case, any remaining amounts due must be deposited into National Liquidators escrow account, within 5 business days after notification of acceptance of an offer (either verbal or electronic). Her expeditionary-styled, tri-deck profile is influenced by the tall bow as well as the Portuguese bridge and pilothouse, features that contribute to her functionality as well as to her aesthetics. Bering 130 features an extremely functional layout on her 31’ beam. The huge sun deck on the flybridge offers a prime location for entertaining, partially shaded by the hardtop and hosting a wet bar, large Jacuzzi, various lounging areas compromising of lots of fitted sun pads.

Stunning upper deck sky lounge reinforces the indoor/outdoor theme with large doors opening out to the aft. The library area, captain’s quarters and pilothouse are all well laid on the upper deck. Alfresco dining for up to 10 and large sun-loungers are available on the aft side of this deck.

Exterior side of the main deck incorporates the lounge area with sun pads, seating and a generous coffee table.

The vast main saloon and dining area (for 10 guests) have huge full-height windows on either side giving the guests a wonderful sea view. The galley, day head and extensive storage areas are also comprised on the main deck.

The forward located full beam master suite comprises a master stateroom with a king size bed, a spacious head and extensive storage areas. Being located on the main deck provides a real convenience over the more typical placement of the master suite in the lower deck, no stairs. In addition to being far more convenient, the master suite offers maximum privacy given the fact it is completely separated from the lower staterooms.

Four luxurious and spacious staterooms comprising large queen size beds and en suite heads make up the lower deck. Fully equipped, dedicated gym and massage therapy cabins, as well as the crew quarters are also located in the lower deck.

Record-breaking Maverick drops out of Bayview Mackinac race after leading

LAKE HURON, MI - After leading the charge up Lake Huron in the 100th annual Bayview Mackinac Race, the record-breaking Maverick dropped out of the race Sunday morning with a mast failure.

A flurry of questions came from race watchers who were following the freshwater sailing race’s online tracker. It showed Maverick, which had been in the lead, taking an abrupt turn toward the shore at Rogers City.

Bayview Mackinac Race officials cleared up the mystery: “Maverick has retired. They suffered a mast failure. All are fine and are headed to Mackinac Island.”

A week ago, Maverick’s crew arrived on Mackinac Island to a cheering crowd after their record-breaking win that smashed the old Chicago Yacht Club Race to Mackinac record by more than an hour. In that race, the big monohull beat Roy P. Disney’s 22-year-old record with a time of 22 hours, 24 minutes, 23 seconds.

This bested the Disney heir’s record set in 2002 with Pyewacket by an hour, six minutes and 11 seconds.

The Maverick team is led by Sanford Burris and William and Ward Kinney. The boat last week also claimed the Chicago Yacht Club Race to Mackinac’s Royono Trophy for the first racing monohull to finish the 115th edition.

This weekend’s Bayview Mackinac Race held the potential for Maverick to make a two-race sweep. The race, which has more than 300 sailing yachts entered, starts at the bottom of Lake Huron and heads north before making the turn to the finish line between Round Island and Mackinac Island.

Racing analysts described today’s early conditions as “champagne sailing” for the tight grouping of boats making their way past Huron’s Northern Michigan coast. Later today, a wind change was expected to have the boats hugging closer to shore.

There’s a small group in the lead now and are expected to reach the finish line by early afternoon.

Boca Raton spec mansion sells for $29M in offseason deal

Trade marks latest eight-figure sale in Royal Palm Yacht & Country Club

Following a busy season for Boca Raton’s priciest neighborhood, another waterfront spec mansion in Royal Palm Yacht & Country Club sold for $28.5 million.

Records show the 360 East Alexander Palm Road Trust, managed by local attorney Jay M. Sakalo, sold the house at 360 East Alexander Palm Road to another trust named for the address and managed by Coral Springs-based attorney Larry Rothenberg. 

The true buyer and seller are unknown.

David Roberts of Royal Palm Properties had the listing, and Joe Liguori of Premier Estate Properties brought the buyer.

The selling entity bought the half-acre property for $10.5 million in 2022, records show. The trust hired local development firm SRD Building, led by brothers Steve and Scott Dingle , to tear down the existing home and construct a 10,700-square-foot mansion, according to records and the listing. The Dingles completed the seven-bedroom spec mansion earlier this year, the listing shows. It has seven bathrooms, three half-bathrooms, a pool and a dock, according to the listing.

Roberts is the go-to agent for Royal Palm Yacht & Country Club spec homes built by the Dingles. He listed the mansion for $33 million in March before upping the price to $34 million in May, Compass shows. 

The sale marks the latest eight-figure deal in Royal Palm, Boca Raton’s priciest gated neighborhood and a hub of luxury real estate activity. 

The Dingle brothers set a record in May when they paid $36 million for a 1.7-acre waterfront teardown in the community, making it the most expensive home ever sold in Boca Raton. 

Other recent deals in the gated golf community include John and Barbara Simoni’s June sale of their waterfront mansion for $19 million . Also last month, Premier Legal Advantage founder Bridget Maguire bought a mansion for $19.5 million . 

Couple in homemade yacht who died and washed ashore in a life raft could have been hit by larger ship, experts suggest

E xperts have offered theories about how a thrill-seeking Canadian couple’s attempted transatlantic sailing expedition turned tragic last month, positing their homemade vessel may have been struck by a much larger ship soon after they departed Halifax on the country’s North East coast.

Earlier this month, the bodies of Brett Clibbery, 70, and Sarah Justine Packwood, 54, were found on a life raft washed up on Sable Island, Nova Scotia.

The area is ominously nicknamed the “Graveyard of the Atlantic” due to the large number of shipwrecks that wind up on its shores.

An official investigation is underway, and although no concrete answers have yet come to light, one leading theory is that their boat was badly damaged by a much larger vessel, forcing the couple to seek refuge in the life raft.

“While they do not have conclusive proof, [investigators] suspect the sailboat … was struck by a bulk carrier likely only a few days after departing Halifax,” a source close to the investigation revealed to Saltwire .

Investigators have reportedly inspected a carrier ship that was in the same area as the couple’s boat — named Theros — at the outset of its voyage, but the results of the probe have not been released to the public.

“The crew of the carrier ship told investigators there were no signs of damage and they were unaware of any collision with a smaller vessel,” the Daily Mirror writes.

The source surmised that the ship’s homemade additions might have presented additional problems, and veteran sailors told the outlet the excessive ballast from batteries and solar panels could have destabilized the boat.

The pair set sail June 11 on a journey that was supposed to take them across the Atlantic Ocean from Halifax to the Azores in their 42-foot yacht, which the couple built themselves.

The eco-friendly boat, which operated without a diesel engine, was due to arrive at its destination by July 2, to serve as a demonstration of how it’s possible to travel the world with electric, wind and solar-powered vessels.

The excursion was to be the couple’s first fully “green” journey on Theros, the building of which the couple chronicled on their YouTube channel, “Theros Adventures.”

Despite the swirling theories about how the doomed voyage turned deadly, the Canadian transportation safety board has not made any formal announcements indicating what happened

“At this time, we cannot say with complete certainty that the sailing vessel was struck by a ship, as we are still gathering information regarding the overdue sailing vessel Theros,” a spokesman said.

Clibbery and Packwood married on the yacht in 2016, one year after they met during a chance encounter at a bus stop in London, England.

Packwood was preparing to donate a kidney to her sister when she met Clibbery, who was visiting from Canada — a heartwarming story that was the center of a  2020 “How We Met” piece in The Guardian.

“We have been traveling and co-creating adventures ever since,” Packwood previously posted on YouTube.

Clibbery’s son, Brett, posted a loving tribute to the couple on Facebook, acknowledging the last few days had been really hard for the family, and news to emerge from the investigation has left it “hard to remain hopeful.”

He continued, “They were amazing people, and there isn’t anything that will fill the hole that has been left by their, so far, unexplained passing.

“Living will not be the same without your wisdom, and your wife was quickly becoming a beacon of knowledge, and kindness. I miss your smiles. I miss your voices. You will be forever missed.”

Largest single-mast ship visits Southwest Harbor

SOUTHWEST HARBOR, Maine — A giant sailboat hasn’t been turning heads in Southwest Harbor this week — not exactly. It’s more like it’s raising those heads and chins and gazes as people look to the skies to locate the top of the largest single-masted sailing yacht in the world.

The M5 has been docked in Southwest Harbor since last week.

One Southwest Harbor resident said that the 89-meter mast can be seen over the trees at the town’s Causeway Club. That mast length is roughly the size of a football field. The boat itself is 78 meters long.

According to SuperYachtFan , “The superyacht  is the brainchild of Irish-based, New Zealand-born yacht designer, Ron Holland, a respected name in the industry. The intricate composite construction of the hull and rig was closely monitored and supervised by High Modulus Europe Ltd, a renowned Hamble-based firm.”

Yachtsinternational.com  says that M5’s giant mast holds a 36,000-square-foot sail.

According to MarineTraffic , she had last been in Providence, Rhode Island. She arrived in Southwest Harbor on July 16.

The yacht is currently owned by Rodney Ray Lewis, who founded Texas-based Lewis Energy Group . Lewis is a renowned pilot. He was a gauger in the late 1970s, purchased an oil well in 1982 for $13,000, and founded the company, which has operations in Texas, Mexico and Colombia. He purchased his first plane a year before the well — a hand-cranked Aeronca Chief. He’s also known as having what Forbes  calls “one of the top vintage warbird collections in the country.”

There is often a plane resting on the back of the yacht. This is also the case in Southwest Harbor. Lewis’ father was a pilot in the Air Force.
