The late Microsoft billionaire Paul Allen's research vessel RV Petrel has been a world leader in marine archaeology in recent years, but has been stuck at Leith Docks since the early months of the Covid pandemic.

A major incident has been declared after the huge research vessel RV Petrel toppled over at Edinburgh's docks, leaving multiple people injured.

Shocking images of the incident, which occurred shortly before 9am on Wednesday morning, show the stricken 250ft ship tipped over to one side at the Imperial Dock in the Leith area of the city.

But what is the RV Petrel, who owns it and how long has it been in the capital? We take a closer look.

What is RV Petrel and who owns her?

Launched in 2002, the Research Vessel (RV) Petrel's primary mission is to explore historically-significant ship wrecks at "challenging depths and conditions". It takes its name from the petrel, a tube-nosed seabird, known for its ability to skim just above the surface of the water.

The ship was previously owned by the estate of Microsoft cofounder, the late Paul G. Allen, who died in 2018.

The US Navy purchased the ship in September 2022 for a reported fee of $12.4 million (£10 million).

Allen, who was ranked as the 44th-wealthiest person in the world by Forbes, with an estimated net worth of $20.3 billion (£16.6bn) at the time of his death, was known for his passion for military history and had made it his mission to fund a research vessel to uncover a fleet of shipwrecks from various different battle sites.

Why is the ship important?

RV Petrel has had great success in this area in recent years, discovering the wrecks of an astonishing 30 sunken warships, including the USS Indianapolis, the ship that delivered the first atomic bomb components to Tinian Island base in 1945, and aircraft carrier the USS Hornet, which played a key role for the US after the Japanese attack on Pearl Harbor.

August 2015 saw Petrel's team commended by the UK Ministry of Defence after the research vessel played a vital role in the recovery of the bell of HMS Hood. The bell was unveiled the following May by the Princess Royal to mark the 75th anniversary of the 1941 sinking of the famous battlecruiser, which remains the Royal Navy's largest loss of life (1,415) from a single vessel.

In October 2019, Petrel's crew were credited with the discovery of another ship lost during the Second World War: the Fletcher-class destroyer the USS Johnston. Scattered more than 20,000 feet beneath the Philippine Sea, it's the deepest shipwreck discovery to date. To put this into context, the wreck of the RMS Titanic lies at a depth of 12,600 feet beneath the North Atlantic.

The ship's long list of major discoveries in the field of marine archaeology have led some to hail RV Petrel as one of history's most important research and exploration vessels, alongside Jacque Cousteau's Calypso and Captain Cook's legendary Endeavour.

What was RV Petrel doing in Edinburgh?

RV Petrel has been moored at Leith since September 3, 2020.

It was announced earlier that year that the ship would be moored indefinitely due to the "impact of the Covid-19 crisis". Subsea director Robert Kraft said at the time that he was "proud" of the ship's many successful missions and that there were hopes Petrel could one day return to service.

At the time of the ship's tipping incident on March 22, 2023, the RV Petrel was drydocking at Leith's Imperial Dock, Scotland's largest deep water impounded dock. It is unclear at this stage how significant the damage will be and what this means for RV Petrel's future.

Edit: We originally stated that RV Petrel is owned by the late Microsoft co-owner Paul Allen. This is no longer the case, as the US Navy purchased the ship in September of last year.

A massive ship once owned by the estate of the late billionaire Microsoft co-founder Paul Allen has toppled over at a dockyard in Scotland, leaving at least 35 injured. 

High winds caused the 250-foot U.S. Navy research vessel, RV Petrel, to become dislodged from its holding on a dry dock. 

A major incident was declared and emergency crews were swiftly called to the Imperial Dock in Leith, Edinburgh.

Scotland’s local TV station, STV, reported there were around 50 refurbishment workers on board, as well as a number of U.S. citizens. The U.S. Consulate in Edinburgh said it was monitoring the situation and offering support.

At least, 12 ambulances, an air ambulance, three trauma teams, and a fire service attended the scene with 21 patients rushed to hospital, according to the Telegraph .

A local politician Adam McVey described the incident as “terrifying” on Twitter. “My thoughts are with those who’ve been injured & hope everyone recovers quickly,” he added.

The ship’s previous owner, Paul Allen, converted it into a deep submergence research vessel in 2017—just a year before he passed away at the age of 65.

The billionaire died of septic shock, a known complication of his non-Hodgkins lymphoma cancer diagnosis. 

With a net worth of $20.3 billion, he ranked as the 44th-wealthiest person in the world at the time of his death, and the RV Petrel wasn’t the only ship he acquired in his lifetime. 

His yacht “Tatoosh” was sold from his estate last November. The lavish 303-footer with five decks was listed for $90 million and sold in-house for an undisclosed sum.

His second superyacht, called “Octopus”, is one of the largest ships in the world at 414 feet. It was sold at around the same time as Tatoosh to the Swedish pharmaceuticals billionaire Roger Samuelsson after originally being listed for $325 million.

Allen’s sister Jody Allen, who was executor of his estate, sold the yachts as per her late brother’s instruction, according to The Street.  

The RV Petrel was also sold in 2022 for a reported sum of $12.4 million to the U.S. Navy.

The ship, which has previously been used for deep-water searches and made global headlines for discovering the long-lost USS Indianapolis in 2017, was put into long-term moorage in 2020 due to “operation challenges” during the pandemic.

It was one of the few ships worldwide equipped to explore 19,685 ft (6,000 m) below the ocean’s surface, and featured a remotely-operated vehicle for use once targets were identified and a multibeam echo-sounder.

It found the World War II-era USS Indianapolis in the Philippine Sea. It is thought that more than 850 crew members died when it sank in 1945, marking the largest loss of life at sea in the history of the U.S. Navy.

“To be able to honor the brave men of the USS Indianapolis and their families through the discovery of a ship that played such a significant role during World War II is truly humbling,” Allen said in a statement at the time.

A large US Navy research vessel dislodged while sitting at a Scotland dry dock on Wednesday, partially tipping over and leaving 33 people injured.

Harrowing photos from the scene show the 250-foot boat, identified as the Research Vessel Petrel, sitting at a 45-degree angle after gusty winds seemingly knocked the ship loose from its holding at Imperial dock in Leith.

The accident garnered a fleet of emergency response services, including 12 ambulances, an air ambulance, three trauma teams, a special operations team, three paramedic response units, and three patient transport vehicles, a spokesperson with the Scottish Ambulance Services told Insider.

Twenty-one patients were transported to local hospitals, while an additional 12 patients were treated at the scene and later discharged, the spokesperson said. 

The Edinburgh Police Division said its officers also responded to the incident, which took place around 8:30 a.m. local time. By 1:30 p.m., all casualties were confirmed and everyone was accounted for, police said.

There is no further risk to the public and police said an investigation will explore what exactly went wrong, according to authorities.

Deidre Brock, an MP who represents Edinburgh North and Leith, said in a tweet that "strong winds" had tipped the ship. 

Photos from the scene show the massive ship sitting tipped halfway over near the dock on Wednesday morning as emergency services removed injured people from the area.

The 3,000-ton ship was originally funded by Microsoft co-founder Paul Allen, who bought the then-offshore service vessel in 2016 and had it retrofitted to serve as an underwater research and exploration vessel. Allen hoped the boat would serve to scan the ocean's depths and locate historic shipwrecks and explore underwater ecosystems.

During its service years, the Petrel discovered several lost shipwrecks, including the USS Hornet and the USS Lexington, two significant US aircraft carriers that were sunk in World War II.

Allen, who was worth an estimated $20.3 billion, died in 2018 at the age of 65 following complications from non-Hodgkin lymphoma.

The Petrel was bought by the United States Naval Facilities Engineering and Expeditionary Warfare Canter in October 2022 and is operated by Oceaneering International, according to the BBC.

Naval Forces Europe did not immediately respond to Insider's request for comment.

Fifteen people have been hospitalized after a huge research vessel owned by the estate of the late Microsoft billionaire Paul Allen toppled over in strong winds in a Scottish dry dock.

Up to 50 people were reportedly on board the RV Petrel , a deep sea research vessel, when the ship keeled over.

The Sun , citing the Scottish Ambulance Service, said that a total of 25 people were injured in the event, of which 15 went to hospital.

Some workers were intially reported to be missing, but reports say all crew have now been located.

The accident, which took place shortly before 9am local time, was classed as a major emergency by Scottish authorities, and paramedics, firefighters, and the coastguard all raced to the scene at Edinburgh’s Imperial Dock.

A source told The Sun : “This is an extremely worrying situation. It’s been very windy since the early hours of this morning, and normal operations had been put on hold until conditions eased.

“Those injured have suffered various injuries, but as far as I am aware, none are in a life-threatening condition. But everyone is very worried for the safety of those currently on board.”

Local councilor Adam McVey tweeted: “Emergency services are responding to a major incident at Leith docks—a ship has been dislodged from its holding in strong winds. Terrifying for those on board, my thoughts are with those who’ve been injured & hope everyone recovers quickly. Please avoid area.”

A Scottish Ambulance Service spokesman said: “We received a call at 0829 hours today to attend an incident in Leith.

“We have dispatched five ambulances, an air ambulance, three trauma teams, our special operations team, three paramedic response units and one patient transport vehicle.”

The RV Petrel , named after a sea bird, is the only privately owned deep-sea research vessel and was equipped by Allen for the purpose of exploring historically significant shipwrecks. Its most famous discovery was the wreck of the USS Indianapolis in August 2017, found at a depth of 18,000 feet in the Philippine Sea.

Allen died of cancer-related septic shock in 2018 at the age of 65.

A research ship owned by the U.S. Navy toppled onto its side while at dock in Edinburgh on Wednesday, leaving dozens of people injured.

The cause of the accident, which left the vessel tipped at a 45-degree angle, was under investigation, the police said. At least 33 people were injured, with 21 of them taken to hospitals, according to the Scottish Ambulance Service.

The 250-foot-long vessel, the Petrel, was bought by the Microsoft co-founder Paul G. Allen in 2016 and underwent extensive refitting to take part in expeditions to explore shipwrecks around the globe. In 2017, the Petrel was involved in the discovery, 18,000 feet beneath the Philippine Sea, of the remains of the U.S.S. Indianapolis , a cruiser that was sunk during World War II in one of the worst disasters in American naval history.

After Mr. Allen’s death in 2018, his estate took control of the Petrel. The ship was placed in long-term moorage in Edinburgh in 2020 because of “operational challenges” during the pandemic and was ultimately sold last year to the U.S. Navy, according to Mark Peterson, a vice president at Oceaneering International, the Texas-based sub-sea engineering company that currently operates the vessel.

“We are monitoring the situation at Imperial Dock in Edinburgh and offering support to U.S. citizens who were involved,” the U.S. Consulate in Edinburgh said on Twitter . “Our thoughts are with all those affected by this incident.”

The U.S. Consulate was not immediately available for comment on whether U.S. citizens were among the injured.

In a statement about the accident in Edinburgh on Wednesday, the police said, “A ship on dry dock has become dislodged from its holding,” without mentioning any cause. A spokesman added that an investigation had been opened.

After the ship toppled over, the Royal Infirmary of Edinburgh, one of the city’s main hospitals, asked people to avoid attending its emergency room if possible because of the high number of injured people expected from what it described as a “major incident.”

Eight people remained in the hospital as of Wednesday evening, “some with serious injuries,” according to statement by the local National Health Service branch. Jacquie Campbell, a senior N.H.S. official in the area, said that it had canceled outpatient appointments and surgeries to free up the surgical staff.

76m research vessel Petrel lists in Edinburgh dry dock

The 76.4-metre research vessel Petrel has become dislodged from her holding and listed at a 45-degree angle on her starboard side in a dry dock in Leith, Edinburgh. The incident occurred as a result of strong winds at around 8.35am this morning (Wednesday 22 March) and emergency services have been dispatched to the site at Imperial Dock.

According to BOATPro , the research vessel, which was formerly owned by Paul Allen, had been on the dock since October 2022.

A statement by Jacquie Campbell, chief officer of acute services at NHS Lothian, indicated that a number of injuries had been reported, with initial reports suggesting 25 injured and 15 in hospital.

"We're on standby to receive a number of patients at the Royal Infirmary of Edinburgh's A&E department following a major incident at Imperial Dock in Leith. We have been reviewing the current capacity at the RIE, with support from other sites, to prepare to accommodate these patients," read the statement.

The statement went on: "Given the expected pressure on the site, we urge people not to attend A&E at the Royal Infirmary of Edinburgh unless it's an emergency."

SNP Councillor for Leith, Adam McVey, attributed the incident to strong winds. "Emergency services are responding to a major incident at Leith docks- a ship has been dislodged from its holding in strong winds. Terrifying for those on board, my thoughts are with those who’ve [sic] been injured," he tweeted.

Petrel was formerly owned by Microsoft co-founder Paul Allen and used as a private research vessel. Allen owned several expedition yachts during his lifetime, including the 126-metre Octopus and 94-metre Tatoosh .

RV Petrel, a 76m research vessel owned by the estate of Microsoft co-founder Paul Allen appears to have been blown over in the hardstand at Imperial Dock in Leith after high winds in Edinburgh. Several injuries have been reported, with two crew members missing at this time.

A spokesman for HM Coastguard said: “HM Coastguard is currently assisting Police Scotland in responding to a major incident at Imperial Dry Dock in Edinburgh.

“At around 9.30am, Coastguard rescue teams from Fisherrow, South Queensferry and Kinghorn were sent to the scene. This is a multi-agency response, with the Scottish Ambulance Service and Scottish Fire and Rescue also in attendance.”

A Scottish Ambulance Service spokesman said: “We received a call at 0829 hours today to attend an incident in Leith. “We have dispatched five ambulances, an air ambulance, three trauma teams, our special operations team, three paramedic response units and one patient transport vehicle.”

A Police Scotland spokesperson said: “Officers and emergency service colleagues are responding to an incident at Imperial Dock in Leith, Edinburgh, whereby a ship on dry dock has become dislodged from its holding. Police were called to attend at around 8.35am on Wednesday, 22 March, 2023 and officers remain at the scene. The public is asked to avoid the area to allow emergency service access."

The "terrifying" incident involving the RV Petrel outside of Edinburgh happened after it became "dislodged from its holding in strong winds," Scottish politician Adam McVey said. 

"Our thoughts and prayers are with everyone affected by this morning's accident in Leith. Sadly many are seriously injured. We are supporting those we can," Sailors’ Society, a Christian charity dedicated to supporting merchant seafarers, wrote on Facebook. 

Images showed the 250-foot ship tilted about 45 degrees to the side.

The Petrel ship, which made global headlines for discovering the long-lost USS Indianapolis in 2017, among other deep-sea wrecks, was placed in long-term moorage in 2020 due to "operational challenges" from the coronavirus pandemic. 

"The impact of the COVID-19 crisis has changed the world for the long term in ways that we never could have imagined," read a post on the ship’s Facebook page in June that year.

"We were tasked with a monumental mission -- discover, educate, and honor -- and we’re hopeful we will eventually be back in service," it added. 

The Scottish Ambulance Service told the BBC on Wednesday that 15 people have been hospitalized after the ship tipped over, while another 10 have been treated and discharged at the scene.

Police Scotland reportedly are urging the public to stay away from the area to allow emergency vehicles to enter. 

Dales Marine Services, the owner of the dry dock where the incident happened, told the BBC that "our priority is to ensure those involved are supported." 

In 2017, the RV Petrel found the wreck of the World War II-era USS Indianapolis in the Philippine Sea. 

The Indianapolis was sank by the Japanese on July 30, 1945, resulting in the deaths of more than 850 crew members on board. 

It was the largest loss of life at sea in the history of the U.S. Navy.

"To be able to honor the brave men of the USS Indianapolis and their families through the discovery of a ship that played such a significant role during World War II is truly humbling," Allen said in a statement at the time. 

The Petrel also has found the wreckage of the Japanese aircraft carrier Kaga after it was sunk by U.S. forces during World War II's Battle of Midway.

Sunken World War II aircraft carrier found by deep-sea expedition

Known for deep-sea exploration efforts uncovering military ships in the past, Paul Allen's personal search team has helped to discover a lost aircraft carrier.

The U.S.S. Lexington has finally been found, decades later and thousands of feet underwater.

The crew of Research Vessel Petrel (R/V Petrel ), the exploration ship of billionaire and Microsoft co-founder Paul Allen , discovered the wreckage of the World War II -era aircraft carrier Monday. It was found about two miles below the surface of the Coral Sea and more than 500 miles off the eastern coast of Australia .

The Lexington is one of the first aircraft carriers built by the U.S. It went down in 1942 with 216 crewmembers and 35 aircraft on board, and it's finally been found.

Wartime Relics

Allen is the son of a WWII veteran, and the R/V Petrel team had been planning to locate the Lexington for about six months after they were given coordinates for where the sunken ship might be. For this, they retrofitted their 250-foot vessel, originally deployed to the Philippine Sea in 2017, with subsea equipment that can reach depths up to three and a half miles. "We're dealing with an environment out here that is very harsh," Robert Kraft , Allen's director of subsea operations, told media. "It's thousands of meters deep and it's very unpredictable. We're putting, you know, a lot of electronics and high voltage down in very deep waters and sea waters where it shouldn't belong, and so that always presents challenges."

First commissioned as a battlecruiser, the Lexington was launched as an aircraft carrier in 1925. On May 4, 1942, the ship fought with the U.S.S. Yorktown against three Japanese carriers in the first carrier-on-carrier battle in history. The Lexington sustained multiple hits from bombs and torpedoes until succumbing on May 8. A secondary explosion had set uncontrollable fires raging through the vessel, triggering the call to abandon ship. The U.S.S. Phelps delivered the final torpedoes that finally sank the ship. With U.S. ships nearby, 2,770 crewmen and officers were rescued from the doomed vessel. Among them was the captain and his dog Wags, the ship's ever-present mascot.

Several ships went under along with the Lexington . The U.S.'s Sims and Neosho succumbed to the waters, and Yorktown sustained damages. The Japanese carrier Shōhō also went under, and the fleet carrier Shōkaku sustained significant damage.

The Battle of the Coral Sea halted a Japanese advance, and it also marked the first time two dueling ships never came within sight of each other.

Under the Sea

Allen's other expeditions have yielded discoveries. His team helped to find the U.S.S. Ward in November 2017, U.S.S. Indianapolis in August 2017, and the U.S.S. Astoria in February 2015. He also helped to find the Japanese battleship Musashi and the Italian destroyer Artigliere in March 2015 and 2017, respectively. Underwater footage shows the large guns and blast shields the carrier once brandished, as well as some airplanes strewn about the ocean floor. Three-quarters of a century submerged underwater has taken a toll on the once-seaworthy vessel, but it is doubtlessly a notable historical and archaeological find.

"It's kind of all this effort you've put in has paid off and for me, personally, I feel a bit of relief and I look forward to the next part of it, which is exploring the wreck," pilot and researcher Paul Mayer told media. "And then very soon after that, I look forward to going and looking for the next one."

Paul Allen’s Petrel research vessel finds the USS Hornet, 77 years after sinking

Chalk up another historic shipwreck discovery for the Petrel , the research vessel funded by the late Seattle billionaire Paul Allen: This time it’s the USS Hornet , the World War II aircraft carrier that was sunk by Japanese forces in 1942.

The Hornet is best-known as the launching point for the Doolittle Raid , the first airborne attack on the Japanese home islands after Pearl Harbor and the United States’ entry into the war. Led by U.S. Army Lt. Col. Jimmy Doolittle , the raid in April 1942 provided a boost to American morale and put Japan on alert about our covert air capabilities.

Two months later, the Hornet was one of three U.S. carriers that surprised and sunk four Japanese carriers during the tide-turning Battle of Midway.

The Hornet was lost near the Solomon Islands in the South Pacific on Oct. 26, 1942, during the Battle of Santa Cruz. The carrier weathered a withering barrage from Japanese dive bombers and torpedo planes — but the crew eventually had to abandon ship, leaving the Hornet to its sinking.

About 140 of the Hornet’s nearly 2,200 sailors and air crew members were lost..

“With the loss of Hornet and serious damage to Enterprise, the Battle of Santa Cruz was a Japanese victory, but at an extremely high cost,” retired Rear Adm. Samuel Cox , director of the U.S. Navy’s Naval History and Heritage Command, said today in a news release . “About half the Japanese aircraft engaged were shot down by greatly improved U.S. Navy anti-aircraft defenses. As a result, the Japanese carriers did not engage again in battle for almost another two years.”

The Petrel took on the search for the Hornet as part of its mission to investigate scientific phenomena and historical mysteries in the South Pacific. The 250-foot research vessel’s previous shipwreck finds include the USS Indianapolis , the USS Lexington , the USS Juneau and the USS Helena .

The ship’s latest expedition took place in January, three months after Allen’s death .

“We had Hornet on our list of WWII warships that we wanted to locate because of its place in history as an aircraft carrier that saw many pivotal moments in naval battles,” said Robert Kraft , who heads the Petrel project as director of subsea operations for Vulcan. “ Paul Allen was particularly interested in historically significant and capital ships, so this mission and discovery honor his legacy.”

The Petrel’s 10-person expedition team zeroed in on the Hornet’s position by piecing together data from national and naval archives that included official deck logs and action reports from other ships engaged in the battle. Positions and sightings from nine other U.S. warships in the area were plotted on a chart to generate the starting point for the search grid.

The discovery of the Hornet was made during the first dive mission of the Petrel’s autonomous underwater vehicle, at a depth of nearly 17,500 feet, and confirmed by video footage from the research ship’s remotely operated vehicle.

CBS News caught up with Richard Nowatzki , a 95-year-old California resident who was a gunner on the Hornet, and showed him video of the aft gun that he operated.

“I used to stand on the right side of that gun, and that’s where my equipment was,” Nowatzki said. “If you go down to my locker, there’s 40 bucks in it. You can have it.”

That might be tough: The precise location of the wreck is not being disclosed, to protect the underwater gravesite from being disturbed any further.

Paul Allen, the co-founder of Microsoft, has put his money into many passion pursuits. Underwater archaeology—specifically, finding ships sunk during World War II—is one of the most prominent. Last August, Allen's research vessel  Petrel discovered the wreckage of the USS Indianapolis , the cruiser that delivered components of the two nuclear bombs dropped on Japan to close the war. A 2015 Allen expedition on his personal yacht Octopus recovered a bell from the HMS Hood , the Royal Navy cruiser sunk by the German battleship Bismarck that   led to the loss of over 1,400 men . The expedition also surveyed the wrecks of "Ironbottom Sound" off Guadalcanal—the site of massive losses by the Allied navies during the long battle for that island.

Now, the Petrel has located the USS Lexington —the aircraft carrier that, along with the USS Yorktown , fought the first-ever carrier duel with the Imperial Japanese Navy in the Battle of the Coral Sea.

The Petrel located the Lexington 's wreck with a Hydroid Remus 6000 drone submersible, an autonomous underwater vehicle equipped for searching large areas of seabed and rated for operations at 6,000 meters (3.7 miles). With its side-scan sonar, the Remus 6000 is capable of mapping over 100 square kilometers per deployment. The Petrel 's Remus is the only privately owned AUV of its type in the world—others are operated by various navies and research institutions. An Argus 6000 remotely operated submersible was used to inspect the wreck visually.

The damage dealt by the Lexington 's and Yorktown 's aircraft to the Japanese carrier Shōkaku , the decimation of the air wing of the carrier Zuikaku , and the sinking of the light carrier Shōhō would change the direction of the war, weakening Japan's naval air power just before the Battle of Midway. The battle also preempted a Japanese invasion of Port Moresby, Papua New Guinea, which would have allowed Japan to attack eastern Australia.

Bombed and torpedoed multiple times, the Lexington was still afloat. But when fires caused by the bombing reached the Lexington 's aircraft fuel stores and burned out of control, the ship had to be abandoned, and the destroyer USS Phelps was ordered to scuttle the ship with torpedoes. It took five to do the job because two torpedoes, including one located by the crew of the Petrel , were duds. The crew abandoned ship, but the Lexington went down with 35 aircraft aboard, settling to the bottom of the ocean two miles beneath the surface; 216 crewmembers died during the fight.

Two newly filed federal lawsuits claim that 10% sales commissions required by South Florida’s yacht broker industry are anticompetitive and violate antitrust laws.

The claims follow an October finding by a federal jury in Kansas City, Missouri, that the National Association of Realtors conspired with brokers to artificially inflate commissions paid to real estate brokers. The ruling, and a March 15 settlement by the Realtors, is expected to radically change how homes are sold in the United States.

Both lawsuits involving yacht brokers name as defendants the International Yacht Brokers Association, based in Fort Lauderdale, the Yacht Brokers Association of America, Boats Group LLC and YATCO LLC.

Also listed as defendants in both suits are a who’s who of South Florida-based yacht brokers, including Denison Yacht Sales, MarineMax Inc., Galati Yacht Sales Inc., Allied Marine Inc., Tournament Yacht Sales LLC and Northrop & Johnson Yacht Ships, among others.

Nearly all of the defendants are headquartered in South Florida.

The most recent suit, filed on March 22, proposes a class of plaintiffs that includes anyone who listed vessels on certain Multiple Listing Services using a listing agent or broker affiliated with one of the defendants and paid a buyer’s broker commission since March 22, 2020.

The lead plaintiff in the lawsuit is Kip Lamar Snell, identified as an Alabama resident. Snell entered into an agreement with Galati to sell a 41-foot Express Cruiser Sea Ray in July 2020 and ended up paying a $12,000 commission on the $120,000 sale price, the suit states. The lawsuit lists as defendants 15 brokers and six organizations that promote the yacht trade or operate Multiple Listing Services.

That lawsuit follows one filed on Feb. 29 that proposes a class of plaintiffs that includes anyone who paid a commission to a listing broker affiliated with the defendants since Feb. 19, 2020. It lists as defendants 11 brokers and five organizations that promote the yacht trade or operate Multiple Listing Services.

The lead plaintiff in that suit is Ya Mon Expeditions, a Wyoming company that paid a “substantial broker commission” when it sold a vessel in January 2023 while represented by Tournament Yacht Sales of Tequesta.

The most recent complaint accuses the trade associations of colluding with brokers to “enforce an anticompetitive restraint that requires (sellers of pre-owned yachts and boats) to pay a brokerage fee to the buyer’s broker and a total aggregate commission fee that is inflated as a condition for selling their yachts.”

The complaint states the typical commission is 10% and is shared between the seller’s broker and the buyer’s broker under terms spelled out in Central Listing Agreements provided by the brokers associations, including the International Yacht Brokers Association and the Yacht Brokers Association of America.

Only boat brokers are able to list boats and yachts on such Multiple Listing Services as YachtWorld.com, BoatTrader.com and Boats.com, and the Multiple Listing Services will not accept listings from owners who want to sell their vessels themselves, the lawsuit states.

Yacht owners are “severely disadvantaged” if they do not list their boats for sale on the listing services, while buyers suffer because their brokers are “financially incentivized” to show boats that will earn them standard “and inflated” commission rates of 4% to 5% through co-brokerage transactions, the complaint states.

None of the defendants contacted for this story responded to a request for comment, and no response has been filed yet in either case.

Robert Allen Jr., whose Miami-based law firm Robert Allen Law represents the International Yacht Brokers Association, did not respond to emails or return a phone call.

A woman who answered the phone at the International Yacht Brokers Association said, “We have no comment on that,” and hung up after a reporter asked for her name.

Of six brokers contacted for comment about the lawsuits, only Tournament Yacht Sales responded to emails. “No comment,” the company’s response stated.

Overall commissions have increased faster than the rate of inflation in recent years as the price of larger boats and yachts have increased, according to the lawsuit that lists Snell as lead plaintiff.

The result is that boat owners pay “hundreds of millions of dollars” in inflated commissions each year, the suit alleges.

Both lawsuits allege violations of the Sherman Antitrust Act that are upheld by “brokers who should be competing with one another but, instead, cooperate with each other to the detriment of pre-owned boat sellers.”

Some brokerages represent both buyers and sellers and retain the entire 10% commissions, the suits state.

The trade associations enforce rules requiring brokers to offer their boats through a listing service and to share commissions, the suits state, adding that they can impose significant penalties on members who do not comply with their rules.

Yacht purchasers are disadvantaged by the current system, the lawsuit alleges, because their agents would otherwise negotiate for their business by decreasing their commission rates.

But buyer brokers’ commissions have remained constant despite their diminishing role, the suits state. Many buyers today find boats they are interested in purchasing through online searches and enlist the services of a buyer’s broker only after identifying the yacht they want to buy, the suits claim.

The lawsuits seek an order declaring the commission structure to be illegal, a permanent injunction outlawing what they describe as anticompetitive conduct, plus damages and/or restitution, pre- and post-judgment interest, and attorneys’ fees.

Paul Geller, an attorney for one of two law firms representing the class that includes Snell, acknowledged “parallels between the allegations relating to commissions in the real estate and yacht markets.”

In the real estate matter, the National Association of Realtors on March 15 agreed to a $418 million proposed settlement that would free home sellers from paying commissions to brokers for both sellers and buyers.

After a jury ruled for the plaintiffs in the case against the National Association of Realtors in October, numerous lawsuits were filed across the country with similar allegations, including one in December against the Florida Association of Realtors and 16 brokerages.

“At bottom, the goals of (the suit against the yacht brokers) are similar: protecting consumers by challenging what we allege to be anti-competitive conduct,” Geller said by email. “We believe in the universal truth that consumers benefit by increased transparency and the competitive pricing that results from negotiated terms, including commissions.”

Geller is a partner at Robbins Geller Rudman & Dowd LLP, which specializes in securities litigation on behalf of investors. The firm has offices in 10 cities, including Boca Raton.
