The American Yacht Charter Association (AYCA) is delighted to announce the continuation of its Educational and Informative Seminars, organized as well as sponsored by the AYCA during the Newport Charter Yacht Show . This year’s show will be running from June 17-20.

2013 Keynote speaker - Jennifer Grace

The AYCA Seminar—which will be held on Wednesday, June 19 in the Sunset Tent at the Newport Yachting Center—includes a full breakfast at 7:30 am and the seminar from 8:00-11:00 am.

Brian Butler, AYCA’s Marketing/Motivational Segment Speaker in 2012, returns in 2013 as Emcee. Hay House Author and Executive Dream Producer, Jennifer Grace, is the 2013 Keynote Speaker. AYCA is delighted to announce her motivational topic: “Directing Your Destiny: How to Become the Writer, Producer, and Director of Your Dreams”

Two other seminar segments are offered as well: “The Charter Voice,” a panel of captain/crew/charter professionals addressing “What Would You Do If…?” questions related to our industry; and, MTN Satellite Communications will bring everyone up to speed on the latest in communications on board yachts in their discussion of, “VSAT for Charter Agents, Managers, and Captains.”

AYCA has made great strides since its inception in 1985 under the leadership of Missy Harvey. 

Most recent efforts entail growing it’s membership while maintaining the strong ethical and professional standards it is known for, and now ACYA is pleased to announce the development of the AYCA E-contract platform.  

This will allow brokers a safe, secure and up to date platform for drafting the AYCA Uninspected as well as the AYCA RBA & VSA Agreements.The AYCA E – Contract platform is the only place where you can create the  newest versions of AYCA Uninspected, AYCA RBA and VSA agreements. It is offered in an easy and convenient online platform and can be  saved and amended during the draft and finalized periods. The AYCA E- Contract will save you time since both AYCA RBA and VSA agreements are created at the same time, one on-line form to be filled out generates two separate agreements!  

This site is hosted on a dedicated server running on the latest OS with Litespeed Web Server and Immunify360 Web Application firewall as well as DNS from Cloudlfare to mitigate DDOS attacks.  The administrator access to the backend has been secured with the maximum length password string ensuring backend access is secure.  All software is auto patched if a known vulnerability is documented.   SSH access to the server has been disabled to all IP addresses except the administrator to prevent any attempts at uploading malicious software.  Immunify360 runs nightly as well as real time file scanning for all uploaded files and immediately quarantine any suspicious files for review.  The filesystem is segregated by user so there is no concern of another broker’s password getting compromised allowing access to your files. In other words, only the broker who generated the contract can access the PDF and contract forms for their contracts.  Broker passwords must be secure to ensure that their own contracts are secure.  If you feel your password has been compromised, use the password reset functionality immediately.  To reset the password you must have access to the email used to create the account.

The database server name, version or location is never disclosed.

Only the Subscriber who has created the record. Client details are stored on the secure database – accessible only by Subscriber of record.

On the Home page of the AYCA E-CONTRACT there is a box in right upper corner of the site which says AYCA SERIAL NUMBER VALIDATOR  where you enter serial number. On entering the Serial Number of your Contract all parties can make sure that it is a valid contract. Click on the link below to AYCA E-Contract validator : https://ayca-econtract.net/serial-number-validator/

The AYCA E-Contract server does not store contract information once the PDF contract has been generated.  (A draft can be saved on the server by User for up to 30 days)

Please note that as long as your contract remains in draft mode the information is stored on the server- however is accessible only to the contract creator.

Unless the Save Draft button is used, the system  will not  save any information –  Save your draft regularly as you work in case you are interrupted or a security timeout closes your session  – deleting all unsaved content.

The final version of your contract can be generated at any time during the period that the draft remains on the server.

Once you have generated your PDF contract – it will be deleted from the server in 7 days, it is important to download this to your hard drive and not rely on the server to keep.

No, this is not permitted and doing so will result in immediate suspension from the e-contract platform. Each individual must register for an personal log in – thus protecting your security.

This AYCA E-Contract Platform Website is a tool to complete the fields on the three AYCA contracts that a qualified Charter Broker or Charter Manager might use in contracting a charter.  It is the responsibility of any Charter Broker or Charter Manager that has a Subscriber Password to already know how to complete each of the three AYCA contracts available to be completed on this AYCA E-Contract Platform Website.

The AYCA Uninspected Passenger Vessel Contract is used to contract American laid hull yachts that are American flag with American crew, including an American Captain that is a U. S citizen with a USCG Captain’s license at the right tonnage for the recorded tonnage on the Federal Document. The Federal Document must include the endorsements of Coastwise Trade (for U.S. to U.S. ports) and (Registry for U.S. to Foreign or Foreign to Foreign ports) and Recreation (for the Owner’s use. Or the yacht could be a foreign laid hull yacht more than 3 years old with a MARAD Waiver and all else as described in that the yacht must have American crew that are American citizens and must have the right licences if required for their position, and the MARAD Waiver must give the rights to the yacht of Coastwise Trade in the area where the charter is to take place and the Federal Document must have been sent in with a request to have Coastwise Trade as allowed by the MARAD waiver for what ever the MARAD Waiver allows as printed on the Federal Document before these rights can legally be accessed as legal us of the yacht for a legal charter contract to draw an Uninspected Passenger Vessel Contract. It is always wise to ask to see the Federal document of the yacht before drawing an Uninspected Passenger Vessel  Contract to assure that the yacht is in fact an Uninspected Passenger Vessel Contract.

Booking Manager

Our latest addition to the team. She brings a wealth of experience with many years of charter booking experience in the Mediterranean, the Caribbean and other locations around the world. She was born and raised in Greece and completed her university studies at Concordia University in Montreal, Quebec.

She lived for many years in Boston, Massachusetts, and in Canada. She has always been interested in the International Trade industry. She worked in the Shipping industry for many years and 10 years ago she entered in the Yachting World which fascinated her at once! She owns the Absolute Yachting charter brokerage house.

She has sailed extensively through the Greek islands and the Turkish coast, thus knows the area very well. She regularly attends shows in the Med and the Caribbean.

Types of Charter Contracts

In order to book a luxury mega yacht vacation , you must sign a contract with the owner of the yacht. Several standard contracts are regularly used within the crewed yacht charter industry. Our experts at Regency Yacht Charters are trained to navigate them all, including those that are used in the Americas, Europe and worldwide.

Luxury Yacht Charter Contracts

Many mega yacht charters are booked using a MYBA contract, which was designed by the Mediterranean Yacht Brokers Association. Other crewed yacht charters are booked with contracts created by the AYCA, which is the American Yacht Charter Association. Regency is a member of MYBA and Kathleen Mullen is a Past President and current Treasurer of AYCA and a member of the Charter Yacht Brokers Association (CYBA). CYBA created a new contract in 2020. Others use what is called a bareboat demise contract.

These various luxury yacht charter contracts cover everything from the yacht’s weekly rate to water toys usage to the conduct that is expected of charter clients. Drug use, for instance, is strictly prohibited in ALL charter contracts and can result in the immediate end of a charter with no refund due to the client. Safety too, is covered in these contracts, which state that the captain will work to meet all your desires—but retains the right to make final decisions to ensure the safety of the yacht, crew and guests. You can expect to see clauses that outline the maximum number of people allowed onboard, what happens if there is a breakdown of the yacht’s equipment, and what insurance the owner must have in place.

Finding the Right Contract

The yacht’s representative decides which contract will be offered based on things like the yacht’s certification in the country where it is registered, including whether it is officially listed as a private or commercial vessel. We are pleased to announce that Missy Johnston , Senior Charter Broker with CharterWorld with Missy Johnston, has been chosen for her second term as American Yacht Charter Association (AYCA) president. Ms. Johnston has certainly earned her place among the ranks of AYCA specialists who aspire to promote all aspects of the private luxury yacht charter industry.

The AYCA has been dedicated to the advancement of yacht chartering practices and legislation since its inception in 1986. The association was initially formed out of necessity; several established yacht brokers needed a plan to allow their charter clients to watch the Tall Ships Parade of 1986 . The original members joined together with a narrow focus, which was quickly broadened to include all aspects of U.S. Coast Guard rules and regulations for both American flag charter yachts and all flag yachts chartering in U.S. coastal and territorial waters. The group expanded with additional experienced Charter Brokers joining the cause, and the AYCA was officially established.

Today, the organization brings together “the best of the best” charter managers and charter brokers who combine their many years of knowledge and experience to boost professionalism, establish top standards, and help in all aspects of charter with U.S. flag yachts and any flag yacht chartering in U.S. coastal and territorial waters. The AYCA works together closely with the U.S. Coast Guard (USCG), the International Maritime Organization, and other yacht charter associations, including international associations such as the Mediterranean Yacht Brokers Association (MYBA), which is the sister organization to the American Yacht Charter Association.

These partnerships form a crucial alliance between charter brokers, legislative bodies, and law enforcement that allows for smoother and more uniform charter standards and contracts around the world. Additionally, being in close contact with other organizations in the United States and around the world ensures that the AYCA, and by extension, CharterWorld with Missy Johnston, is in front of any changes in maritime laws, yachting practices, and any other information about which a charter client should be advised for the best and safest yacht charter possible.

In addition to the many other benefits, AYCA members, through active participation in the association, receive an understanding of complex matters such as maritime laws, regional laws, and safety issues. Any client who works with an AYCA professional enjoys the expertise and support of an entire association determined to make their experience as seamless, safe, and pleasant as possible.

A Full Member of the AYCA is required to have seven years of experience as a Charter Broker or Charter Manager before becoming a Member. Succeeding in a position that requires seven years of being an active charter broker came naturally to Ms. Johnston, with more than 30 years in the charter brokerage industry. She is happy to lead and serve such a dedicated group of professionals.

During her first term as president, Ms. Johnston worked helping to write the Passenger Vessel Safety Act of 1993, one of the most important pieces of legislation in the U.S. addressing yacht charter. During her help in writing this law, Ms. Johnston met with USCG representatives and the USCG Legal Department in Washington DC, along with maritime committee members in the House of Representatives and provided constructive information on the industry to develop the most appropriate law possible. Her contribution to this federal law laid the groundwork for her future work assisting with developing contracts and agreements for yacht charter under American Admiralty Law.

Notably, Ms. Johnston was integral to the writing of the AYCA Uninspected Passenger Vessel Contract and the AYCA Demise Contracts, including the Recreational Bareboat Contract and the Vessel Services Contract. She is continuing to work on the latest revisions of all three of these contracts along with other important projects during her second term as president.

Additionally, Ms. Johnston helped with the industry development of the MARAD waiver , application of which, for the right yacht, allows that yacht to move from recreational charter to commercial charter, which is more favorable for the owner and charterer.

As a charter broker since 1988, Ms. Johnston puts her Bachelor of Architectural History degree to good use. She develops detailed itineraries for her clients to enjoy and puts her knowledge and passion into highlighting the fascinating historical and archeological sites travelers can visit during their yacht charter vacations.

Ms. Johnston has been an active member of the AYCA since 1991, and has served as Vice President, Secretary, and as a member of the Board for many years and now for a second term as President.
