1989 President 52 Cockpit Motoryacht Board the President through the doors to the air conditioned aft deck. A few steps up to the roomy bridge, with a center console helm, and all up-to-date electronics. The enclosed bridge has plenty of seating, a tv with satellite, air-conditioning and a large refrigerator. It has a passage way to the dingy on the upper deck. A few steps down from the aft deck and you are in the salon with teak woodwork, and custom draperies and sofa. The surround sound stereo with remote controls is to the right. Forward and down a few steps is the galley to left and dining table to right. Forward of the galley is the guest stateroom with storage and a private head. Aft of the salon is the master stateroom, with storage and a private head.

President Biden derided Supreme Court Justice Clarence Thomas for failing to disclose trips he took with a Republican donor, referring to the high court’s longest-serving current justice as “the guy who likes to spend a lot of time on yachts” in an interview published Monday.

Biden, 81, made the cutting comment to The New Yorker while discussing whether the high court’s conservative majority would revisit other precedents after overturning Roe v. Wade, the landmark 1973 decision that granted constitutional protections for abortion, in June 2022.

In a concurring opinion on the ruling, Dobbs v. Jackson Women’s Health Organization, Thomas suggested the justices should revisit other precedents legalizing contraception and same-sex marriage, as well as decriminalizing homosexuality.

All those decisions were based on the legal theory of “substantive due process,” which states that rights not specified in the Constitution are protected by the 5th and 14th Amendments.

“Because any substantive due process decision is ‘demonstrably erroneous,’” Thomas, now 75, wrote at the time, “we have a duty to ‘correct the error’ established in those precedents.”

Biden batted down the suggestion during his interview.

“I don’t think there’s a majority to go there,” he said, before pivoting to criticize Thomas for more than 20 years of excursions on billionaire GOP donor Harlan Crow’s superyacht and private jet.

While serving as chairman of the Senate Judiciary Committee, Biden voted against the confirmation of Thomas to the Supreme Court in 1991 following allegations of sexual harassment by Anita Hill, who worked under Thomas at the Education Department and Equal Employment Opportunity Commission.

Thomas dismissed Hill’s testimony as “lies” and said the widely televised hearings amounted to a “high-tech lynching for uppity blacks.”

The justice was confirmed by narrow 52-48 vote in the Senate, with 11 Democrats and 41 Republicans supporting his appointment. At the time, such a tight margin was almost unheard of; no justice had been confirmed with fewer than 60 Senate votes since 1949 — and none would be again until Samuel Alito in 2006.

A federal judge on the DC Circuit Court of Appeals at the time of his nomination, the conservative Thomas replaced retiring Justice Thurgood Marshall, a liberal and the high court’s first African-American jurist.

Last year, ProPublica reported that Thomas had “accepted luxury trips virtually every year” for decades from Crow, a Dallas-based real estate mogul, without listing them on his financial disclosures with the high court.

One 2019 jaunt to Indonesia with his wife, Virginia Thomas, and Crow would have cost more than $500,000 had the justice chartered his own flight and yacht, according to the outlet.

“Early in my tenure at the Court, I sought guidance from my colleagues and others in the judiciary, and was advised that this sort of personal hospitality from close personal friends, who did not have business before the Court, was not reportable,” the justice said in a statement at the time.

“I have endeavored to follow that counsel throughout my tenure, and have always sought to comply with the disclosure guidelines.”

Democrats on the Senate Judiciary Committee later opened an investigation into Thomas and threatened to subpoena Crow — but have yet to do so.

In November, the Supreme Court adopted its first-ever ethics code , laying out guidelines for the disclosure of reimbursements for travel, food and lodging.

While congressionally mandated ethics rules govern the behavior of lower court judges, Alito has said the Constitution grants no such authority to Congress in overseeing the Supreme Court.

Sen. Dick Durbin (D-Ill.), who chairs the Judiciary Committee and led the probe of Thomas, has since suggested the justice also has conflicts of interest that should prompt his recusal from former President Donald Trump’s upcoming appeal of his 2020 election interference case in Washington, DC.

Virginia Thomas, a longtime conservative activist, attended Trump’s “Stop the Steal” rally on Jan. 6, 2021, in DC before the Capitol riot and pressured then-chief of staff Mark Meadows to challenge 2020 electoral results , the Washington Post reported.

On April 22, the Supreme Court will hear oral arguments from Trump’s attorneys, who argue the former president should not be criminally prosecuted for his attempts to overturn Joe Biden’s victory.

The Post has reached out to the Supreme Court for comment.

The Trump trials: A former president faces justice

On March 25, in room 1530 of Manhattan Criminal Courthouse, a trial unlike any other is scheduled to begin: A criminal trial of a former U.S. president, Donald Trump.

"We've never been in a situation like this where we've been faced with the prospect of holding a former leader to account," said Melissa Murray, who teaches constitutional law at the New York University School of Law.

Andrew Weissmann, who teaches criminal procedure at NYU, said, "If you think of American history, there are sort of defining moments: There's the actual promulgation of the Constitution, there's the Civil War. And I think that, without hyperbole, this is a defining moment in terms of having a criminal case [of a former president]."

To be clear, Trump is no stranger to the legal system, and recent civil judgments may cost him nearly half a billion dollars.

But what makes this a defining moment, say Weissmann and Murray, is that he is facing 91 criminal charges in four different courtrooms . In New York, Trump is accused of falsifying business records. In Washington, D.C., and Georgia, he is charged with allegedly conspiring to overturn the 2020 election. And in Florida, he was indicted for keeping classified documents at his Mar-a-Lago property.

What's at stake now for Trump is not just his finances, but possibly his freedom.

Murray said, "The fact that we have these four indictments shows that there is an appetite for accountability. But is he too much for the American legal system? I think that's what we're going to find out."

Because overshadowing this tangle of trials is the fact that Defendant Trump is also Candidate Trump. 

Robert Ray, a former federal prosecutor who successfully defended Trump when he first faced impeachment in late 2019, said, "I think the country is gonna rue the day that we ever traveled down this road. What federal prosecutors want is ... the public to come to accept that the defendant was afforded fairness. I think there's a good percentage of the country right now that doesn't believe that."

And that is why professors Weissmann and Murray put together what they say is an impartial guide to "The Trump Indictments."

Weissmann said, "There are facts that are disputed in four criminal cases, and our job is to translate that for people, hopefully who really will understand that they need to get engaged."

They begin not with the New York case, but the one that they believe levels the most serious charges: United States of America vs. Donald Trump, being heard in Washington, D.C. Last August, Jack Smith, the special counsel appointed by Attorney General Merrick Garland, charged Trump with conspiring with others to interfere with the results of the 2020 Presidential election. The indictment unsealed charged Trump with conspiring to defraud the United States.

"The sort of gist of it is that you have a plot to disrupt the counting of the votes," Weissmann said.

Smith alleges Trump knowingly made false statements about election results in states like Georgia, and according to court filings cites as evidence Trump's own social media posts, like this one from December 3, 2020, in which he falsely accused Democrats of stuffing ballot boxes:

Smith also alleges "the Defendant lied" to Georgia Secretary of State Brad Raffensperger to induce him to alter Georgia's vote count in that now-famous telephone call on January 2, 2021 . ["I just want to find 11,780 votes, which is one more than we have."]

But former Trump attorney Robert Ray said a jury may hear that phone call differently. "'Finding votes' doesn't necessarily mean, 'Find me 11,000 fraudulent votes,'" Ray suggested.

He adds that Trump will argue he was exercising his right to "free speech." But attorney Weissmann counters that: "I was a prosecutor for many years. There's no first amendment protection in terms of a criminal case. If you are to rob a bank and say, 'Give me all your money,' that speech, none of that, is protected."

Special Counsel Smith announced, "My office will seek a speedy trial so that our evidence can be tested in court and judged by a jury of citizens." But that "speedy" trial (which was originally scheduled to begin in a federal courtroom in Washington, D.C. tomorrow) ran into a roadblock earlier this year, after Trump's lawyers made a claim that echoed one made by a former president 50 years ago, when Richard Nixon told interviewer David Frost, "When the President does it, that means that it is not illegal."

Trump asserts he is protected from prosecution by "presidential immunity." While that claim was initially thrown out by a federal appeals court, Trump asked the Supreme Court to weigh in . And in a win for Trump, just this past week, the justices agreed to hear arguments on the case in April .

Murray affirmed that even a case built for speed can be derailed by delays. "Donald Trump once wrote a book called 'The Art of the Deal.' This is the art of delay," she said. "And he's played it very well."

Ray said, "There's no question that it is desirable politically for Donald Trump to delay these cases until after the election, for obvious reasons. He's entitled to take that position."

It's a strategy that presidential historian Douglas Brinkley says Trump learned from controversial attorney Roy Cohn, chief counsel to Senator Joseph McCarthy in the 1950s, who also represented the Trump Organization in the 1970s.

"What Trump has going for him is that he learned how to stall and defer and postpone, kick the can," Brinkley said. "But more than that, he learned never admit defeat."

But as much as they have tried, Trump's lawyers have not been able to delay, or dismiss, the case of the People of the State of New York vs. Donald Trump. Last year, Manhattan District Attorney Alvin Bragg alleged that Donald Trump had falsified records to conceal a bigger crime: election fraud. 

"Under New York State law, it is a felony to falsify business records with the intent to defraud and the intent to conceal another crime," Bragg said. "The defendant claimed that he was paying Michael Cohen for legal services performed in 2017. This simply was not true."

Instead, Bragg said "hush money" went to pay Stephanie Clifford, an adult film star better known as Stormy Daniels, to buy her silence about an alleged affair with Trump before the 2016 election. While some legal observers question the strength of the case, Trump's former lawyer Michael Cohen was convicted of similar charges in 2018, and sentenced to three years in prison.

Jurors chosen for Trump's trial will likely remain anonymous, and no cameras will be allowed inside the courtroom. What's more, unlike his previous civil trials, Trump will be required to be in court instead of on the campaign trail. Murray said, "This is about defending his rights, him showing up in court and being able to mount a vigorous defense to the charges against him. That's his right as a defendant."

That won't keep him from holding court outside, as he did after a recent hearing, when he told the cameras, "Nobody's ever seen anything like it in this country, it's a disgrace."

Ray said "of course" Trump will use the Stormy Daniels case as part of his campaign: "He has done that with regard to every other stage of these prosecutions. Why would this trial be any different?"

Manhattan D.A. Bragg has already asked the judge to rein in Trump with a partial gag order . But Ray blames the prosecutors for taking a candidate to trial just months before a presidential election.

Moriarty asked, "Are you saying that former leaders should never – when they are running for election – ever be held accountable for alleged crimes?"

"No, but I'm saying that the unusual circumstance that we find ourselves in is that we have four pending indictments in an election cycle," Ray replied. "That is a result that I think most people would agree is undesirable."

"But Bob, he gets to bring in his evidence, he gets to cross examine witnesses, and he could be acquitted. And that would help him in an election year."

"I think there are questions about whether or not Donald Trump can get a fair trial in the District of Columbia, as there are whether or not he can get a fair trial in Manhattan, given the potential juries," said Ray.

But professor Murray is confident that juries made up of American citizens are more than up to the task: "I think very few jurors go into there like, 'I'm a Democrat.' 'I'm a Republican.' I think they go in there like, 'I'm a juror, and I'm an American, and this is my civic duty.'"

More than 1,400 pages of emails, text messages and other documents released Monday reveal details of a strategy by Republican operatives tied to then-President Donald Trump to overturn Joe Biden’s 2020 victory in Wisconsin. The documents — settling a civil lawsuit filed against two attorneys and 10 Wisconsin Republicans who posed as fake electors — also allow a deeper look into how the strategy played out in other battleground states.

WHO’S BEHIND THE LAWSUIT?

Two Wisconsin Democratic electors and a voter filed the lawsuit in 2022 alleging a conspiracy by Trump and his allies to overturn his loss in the presidential race in the state.

It named attorneys Kenneth Chesebro and Jim Troupis, along with 10 Republicans who signed documents falsely stating they were electors. The electors settled in December. Chesebro and Troupis settled by agreeing to turn over the documents.

Chesebro worked closely with the Trump campaign. Troupis, a former judge, served as Trump’s attorney in Wisconsin.

WHAT DOES THE SETTLEMENT MEAN?

The settlement lays bare the orchestrated plan to keep Trump in office by creating paperwork and pulling together false slates of Republican electors in Wisconsin, Michigan, Georgia, Pennsylvania, Nevada, Arizona and belatedly New Mexico.

The trove of documents shows the plot’s origins in Wisconsin — which federal prosecutors have also noted — and how it was replicated with coordination between the attorneys and the Trump campaign.

“The goals of the lawsuit were about transparence, accountability and deterrence,” said attorney Jeffrey Mandell, who helped negotiate the settlement for the plaintiffs.

Chesebro and Troupis didn’t admit any wrongdoing or liability, but they have promised never to participate in similar efforts. Troupis must also pay an undisclosed amount.

Text messages between the two in the final months of 2020 show how they looked for ways to draft false certificates for the fake electors, among other things.

There are no communications directly from Trump, but there are glimpses into an Oval Office meeting and White House communications.

When Chesebro shares a memo on strategies , Troupis responds with: “I have sent it to the White House this afternoon. The real decision makers.”

WHO ARE ELECTORS?

Electors are appointed by state parties to represent voters.

The job is often given to current and former party officials, state lawmakers and party activists. The winner of the state’s popular vote typically determines which party’s electors are sent to the Electoral College, which convenes after the election to certify the winner. Electors gather in their respective state capitols in December to certify their statewide popular vote winner.

Trump lost Wisconsin by fewer than 21,000 votes, but as part of the scheme, the electors claimed he had won the state.

Monday’s document release includes a 10-minute video shot by Chesebro of the fake Wisconsin electors filling out ballots for Trump, cheering and taking photos.

Troupis said Monday in a statement that the alternative ballots were part of a “reasonable course of action” as the election results were appealable. His attorney Matthew Fernholz dismissed the case as “a politically driven civil lawsuit.”

WHERE DO THINGS STAND OUTSIDE WISCONSIN?

The fake electors in Wisconsin have — so far — gotten off easier than their counterparts in some other battleground states where fake certificates were sent to Congress falsely declaring Trump the winner of the 2020 presidential election.

In Michigan, 16 people initially were charged with forgery and other crimes. Six Republicans in Nevada , including the state’s GOP party chair and Republican National committeeman, were indicted in December on felony charges.

Meanwhile, 18 people — including Trump and several of his top lawyers — were charged last summer in Georgia . Three of those charged are accused of being fake electors. Several lawyers, including Chesebro, agreed to plea deals.

New Mexico Attorney General Raúl Torrez, a Democrat, said in January that he wouldn’t prosecute . Charges also haven’t been filed in Pennsylvania or Arizona.

WHAT DO THE CASES HAVE IN COMMON?

The documents offer a glimpse into the strategy’s origins in Wisconsin and the major role that Troupis played. But across the other cases, Chesebro remains in the spotlight.

The indictment in Georgia alleged he coordinated and executed the plan to have Georgia Republicans sign a certificate declaring falsely that Trump won the state and declaring themselves “duly elected and qualified” electors.

He pleaded guilty to a felony in October in the Georgia case.

Chesebro also cooperated with authorities in Nevada, testifying before a grand jury in November. He also could be called to testify as a defense witness in Michigan.

Documents in Monday’s settlement show how Chesebro was in direct communications with top Trump campaign officials for an assessment of how states were doing with the plan.

P resident Biden disparaged Supreme Court Justice Clarence Thomas in an interview with the New Yorker and referred to him as a justice who "likes to spend a lot of time on yachts."

The New Yorker asked the president during an interview if he believed the Supreme Court would apply the legal rationale in the Dobbs case, which overturned Roe v. Wade, to same-sex marriage, "the decriminalization of homosexuality," and contraception access.

Thomas raised the possibility in his concurring opinion in the Dobbs ruling. Biden told The New Yorker that he didn't think the Supreme Court majority would go there.

"I think that a couple on the Court would go considerably further," Biden told the New Yorker, specifically, "the guy who likes to spend a lot of time on yachts."

The New Yorker's reporter asked Biden if he was referring to Justice Thomas and wrote that the president "grinned" at the question.

The president also said during the rare media interview that he wanted to pass Roe v. Wade "as the law of the land" and said Democrats would need to gain more seats in Congress.

"I’ve never been supportive of, you know, ‘It’s my body, I can do what I want with it.’ But I have been supportive of the notion that this is probably the most rational allocation of responsibility that all the major religions have signed on and debated over the last thousand years," Biden said, explaining his position. 

A ProPublica report from 2023 said Thomas took luxury trips on yachts and private jets owned by Texas businessman Harlan Crow without reporting them on financial disclosure forms. A 2019 trip to Indonesia, the story detailed, could have cost more than $500,000 had Thomas chartered the plane and yacht himself, the report said.

Supreme Court justices are required to file annual financial disclosure reports, which ask them about gifts they've received. 

The magazine noted the politics of abortion have been historically difficult for the president. An aide told the New Yorker it's always been a "hard issue" for Biden, as someone who the president said was "not big" on abortion. 

"But it became a very easy issue for him because of the Supreme Court," the aide said. 

Fox News Digital has reached out to the Supreme Court for comment.

The Supreme Court agreed to review whether former President Trump was immune from prosecution in the federal election interference case last week.

The justices have fast-tracked the appeal, and will hear oral arguments in late April, with a ruling on the merits expected by late June. Trump's criminal trial has been put on hold pending resolution of the matter.

On Monday, the Supreme Court ruled unanimously that Trump could not be removed from the 2024 primary ballot in Colorado.
