How To Buy a Luxury Yacht: An Expert Guide

Owning a luxury superyacht is a dream of many. And that dream becomes a reality with the help of a luxury yacht brokerage and an experienced broker. David Seal , of the famed Yachts for Sale YouTube channel, sat down with Northrop & Johnson CCO Cromwell Littlejohn to answer the most common questions about purchasing a yacht and to map out a complete buyer’s guide for potential yacht owners.

Size, style and builder

When shopping for a yacht, one of the bests parts is the seemingly countless options of sizes, styles, and builders. The possibilities are endless, from classic motor yachts to ultra-modern superyachts, stunning sailing yachts to global explorers and beyond. If you’re contemplating a yacht purchase, keep in mind the following questions:

• How will you use the boat? (get VERY realistic here)
• Are you looking for a new or pre-owned yacht?
• Custom built, semi-custom or production?
• Are you looking for a high-speed performance boat or one with extended cruising capabilities?
• What size range would you like to stay in?
• What price range would you like to stay in?
• Do you have intentions to put your yacht on the charter market?

Once you have an idea of what you’re looking for, the next step is working with a dedicated broker to make your dreams come true.

Your broker is your new best friend

“The process of buying a brokerage yacht is pretty straightforward, the devil is in the details,” states Seal.

“Having that information and guidance from an experienced, knowledgeable broker is key,” Littlejohn assures.

Your broker will compile a list of yachts on the market – and perhaps include options not publicly known to be available that best meet your search criteria, such as styling, number of staterooms, amenities and budget.  

Let’s negotiate

Once you and your broker have selected the perfect yacht, the next step is negotiation, presenting offers, sea trials and surveys. Your Northrop & Johnson broker will walk you through all the necessary steps and prepare you for what to expect during this process.

Seal asks, “Do you recommend people try a cheeky offer first, a very low-ball offer?”

“I think we’re always trying to get the boat at the best price we can for our clients. What we don’t want to do is come in so low that we insult somebody and then find that they no longer wish to negotiate with us…we’ll do all the necessary market research and find data that provides us with a well-rounded understanding of the boat’s true value on the market. This way, we can get in and out of it properly, and from there we’ll advise and see where we end up” replies Littlejohn.

“Let’s say the offer is accepted; where do we go from there?” says Seal.

Littlejohn says, “If we back up a bit, we can get to how we present that offer. To present the offer, we need to put it in writing on the best contract to use, then there are some dates we have to concern ourselves with; these also need to be added to the contract. These include acceptance/rejection dates, closing dates, etc… We put the number down [with] any additional terms we may be considering such as sea trials and surveys and such, and then from there we put the agreement together; we need to be prepared to back that up with a 10% deposit based on the selling price that we’re offering.”

What happens next?

Your N&J broker will assist in scheduling a buyer’s sea trial and condition survey. This is to essentially “test drive” the yacht and have the opportunity to identify any deficiencies or discrepancies, whether that be mechanically or aesthetically.

Littlejohn states, “There may be further negotiations post-survey based on the findings. This may allow us to get the owner or the seller to fix items or give us a monetary credit for those items that we can fix once we own the boat.”

“That’s a really important point for [those] who have not bought a yacht before or are thinking of buying a yacht,” states Seal. “…this is not like buying a used car where you take it off the lot, and it’s your problem after that- you do your sea trial and survey and let’s say for example that I’ve offered $4,00,000 on a yacht, and you take it out to sea and the stabilizers don’t work-it’s not a take it or leave it situation is it?”

Littlejohn replies, “…we may go back to that seller and ask them to fix that and repair it, and in most cases, we’ll make those repairs subject to our surveyor’s review of the repairs and confirmation that they were done in a proper and “yacht-like” fashion, or we may come back and say we think it’s going to cost us this much and we’d like to re-negotiate the agreement to that extent.”

Once a final agreement has been made post sea trial and survey, the necessary documents will be exchanged. There are a few other factors to consider before the payment is made and the sale is completed.

“We’re now getting to acceptance day. The buyer will have to register the yacht. How easy is that, and, as a brokerage company, how involved does N&J get with that side of things?” asks Seal.

“Most of the brokers, especially those at N&J, are familiar with the requirements, the benefits and the downfalls of the different flag states. Each flag state has its own set of rules, which sometimes go as far as licensing requirements for crew, how many crew you have to be (safe manning requirements). As such there are several choices when it comes to flag states. Knowledgeable brokers have upfront conversations with their buyers about all of these aspects of yacht registration,” answers Littlejohn.

Some new yacht buyers may feel they can navigate the waters of yacht purchase on their own, but factors like where to register a new yacht really showcase the importance of having an experienced broker in your corner who can guide you in the right direction for your needs. Once all the technicalities are sorted out, the payment is submitted and the deal closed. But much like taking home an infant from the hospital, there is no “handbook” on yacht ownership. This is another reason working with an experienced broker is advantageous. Your broker will advise you on all things concerning yacht ownership. From documentation and insurance to crew and charter marketing, your broker will guide you on how to best manage your new vessel.

A common question answered

One of the most common questions regarding yacht purchase: “What’s it all about when you see an advert on a yacht, and it says “Not for sale or charter to U.S. residents while in U.S. waters?” asks Seal.

“That’s a law that goes back hundreds of years in U.S. history, and it disallows the ability to offer boats for sales or charter to U.S. residents if the boat is foreign-built or foreign-flagged and has not been imported into the United States. There are a few different ways to navigate this restriction. One is to have the seller move the yacht to a free trade zone (FTZ). This is a new option that only came about within the last three or so years. Another way for US buyers to purchase foreign-built or foreign-flagged yachts is to purchase them at a boat show under a boat-show bond or to close the deal on the yacht offshore in international waters or a country close to the US. In many cases, before free trade zones, buyers and sellers would cruise the yacht from the US to The Bahamas for the buyer to inspect and purchase the yacht legally.” answers Littlejohn.

“We’re actually in a free trade zone here (in Fort Lauderdale at the Northrop & Johnson office); what’s the benefit of that to Northrop & Johnson?” asks Seal.

“It gives us the ability to sit boats right outside of our office and offer them for sale to U.S. residents while in the free trade zone. It makes the whole process much easier for both the seller and the potential buyer as he or she can come to the N&J office and inspect or purchase the yacht with ease,” states Littlejohn.

Russian oligarch's yacht is costing U.S. taxpayers close to $1 million a month

A mega-yacht seized by U.S. authorities from a Russian oligarch is costing the government nearly $1 million a month to maintain, according to new court filings.

• The Justice Department is seeking permission to sell Amadea, which it seized in 2022, alleging that it was owned by sanctioned Russian billionaire Suleiman Kerimov.
• Attorneys for Eduard Khudainatov, an ex-Rosneft CEO who has not been sanctioned, say he owns the yacht, and have sought to take back possession of the vessel.

The U.S. Department of Justice is seeking permission to sell a 348-foot yacht called Amadea, which it seized in 2022, alleging that it was owned by sanctioned Russian billionaire Suleiman Kerimov. The government said it wants to sell the $230 million yacht due to the "excessive costs" of maintenance and crew, which it said could total $922,000 a month.

"It is excessive for taxpayers to pay nearly a million dollars per month to maintain the Amadea when these expenses could be reduced to zero through [a] sale," according to a court filing by U.S. prosecutors on Friday.

The monthly charges for Amadea, which is now docked in San Diego, California, include $600,000 per month in running costs: $360,000 for the crew; $75,000 for fuel; and $165,000 for maintenance, waste removal, food and other expenses. They also include $144,000 in monthly pro-rata insurance costs and special charges including dry-docking fees, at $178,000, bringing the total to $922,000, according to the filings.

The battle over Amadea and the costs to the government highlight the financial and legal challenges of seizing and selling assets owned by Russian oligarchs after the country's invasion of Ukraine. European Commission President Ursula von der Leyen said last week that the European Union should use profits from more than $200 billion of frozen Russian assets to fund Ukraine's war effort.

Her comments echoed government calls in the spring of 2022 to freeze the yachts, private jets and mansions of Russian billionaires in hopes of putting pressure on Russian President Vladimir Putin and raising money for the war effort.

Yet, nearly two years later, the legal process for proving ownership of the Russian assets and selling them has proven to be far more time-consuming and costly. In London, Russian billionaire Eugene Shvidler has waged a court battle over his private jets that were impounded, and Sergei Naumenko has been appealing the detention of his superyacht Phi.

The battle over Amadea began in April 2022, when it was seized in Fiji at the request of the U.S. government, according to the court filings.

Though the U.S. alleges that the yacht is owned by Kerimov, who made his fortune in mining, attorneys for Eduard Khudainatov, an ex-Rosneft CEO who has not been sanctioned, say he owns the yacht, and have sought to take back possession of the vessel.

In court filings, Khudainatov's attorneys have objected to the U.S. government's efforts to sell the yacht, saying a rushed sale could lead to a distressed sale price and that the maintenance costs are minor relative to the potential sale value.

Khudainatov's attorneys refuse to pay the ongoing maintenance costs as long as the government pursues a sale and forfeiture. However, they say their client will reimburse the U.S. government for the more than $20 million already spent to maintain the yacht if it's returned to its proper owner.

In court papers, the government says Kerimov disguised his ownership of Amadea through a series of shell companies and other owners. They say emails between crew members show Kerimov "was the beneficial owner of the yacht, irrespective of the titleholder of the vessel."

The emails show that Kerimov and his family ordered several interior improvements of the yacht, including a new pizza oven and spa, and that between 2021 and 2022, when the boat was seized, "there were no guest trips on the Amadea that did not include either Kerimov or his family members," according to the court filings.

The government also says Kerimov has been trying to sell Amadea for years, so a sale would be in keeping with his intent.

"This is not a situation in which a court would be ordering sale of a precious heirloom that a claimant desperately wishes to keep for sentimental reasons," the government said in filings.

Even if Amadea were sold quickly, the proceeds wouldn't automatically go to the government. Under law, the money would be held while Khudainatov and the government continue their battle in court over the ownership and forfeiture. Don't miss these stories from CNBC PRO:

As a hospital system crashes, Steward’s CEO rises above it all

Let’s begin by paying homage to the Bombardier Global 6000, among the most perfect forms of transportation ever created. How perfect? This private aircraft is nearly 100 feet long. It costs $62 million new. It has a range of 6,000 nautical miles, meaning it can fly nonstop from Aspen to London or New York to Moscow. It holds as many as 17 passengers in luscious club seats, never loses internet connectivity, and can be configured with a bedroom and full shower. It’s basically Air Force One without the president.

The Bombardier website, in fact, makes repeated references to an aircraft that befits “a head of state.” It’s the jet that whisked Taylor Swift from Tokyo back to the United States to watch her boyfriend win the Super Bowl.

But perhaps the ultimate seal of approval for the Bombardier Global 6000 comes not from any global leader or the most popular musical performer alive, but from someone slightly less known but no less discerning. It is the private jet that Steward Health Care Chief Executive Officer Ralph de la Torre has chosen to fly around the world.

Yes, that’s right. De la Torre, the proud owner of a $40 million, 190-foot superyacht and the most sophisticated sportfish boat ever built (cost: more than $15 million), is cruising the skies in one of the biggest and most luxurious private jets that money can buy — in this case, Steward’s money.

And lest anyone think that I’m going to make the same mistake twice and miss a jet, I can definitively report that Ralph de la Torre likes things in pairs. Steward also operates a second private plane, a Dassault Falcon 2000LX that can easily soar nonstop from Boston to Europe with as many as a dozen passengers in ultra-luxury. Not to put too fine a point on it, but having a Falcon 2000LX as a spare jet is like having a Bentley as the beater you take to the town dump.

You, like me, might be wondering why a for-profit health care system with particularly fragile hospitals often located in low income communities might choose to spend tens of millions of dollars to own and operate two fabulously luxurious private jets, especially when the company is headquartered in a major airline hub like Dallas that has nonstop flights to virtually any destination that any normal person would want or need to go.

First, though, it’s worth noting that Steward didn’t seem particularly eager to have the public know about these jets. They were registered with the Federal Aviation Administration under the name of an aviation holding company called TVPX. That company, with offices in Concord, Mass., and North Salt Lake City, declares on its website that it creates trusts for airplane owners who “want to avoid unwanted public or media attention.” How did that one work out?

Fortunately, a kind person sent me the tail number to the Bombardier. That tail number opened all sorts of doors in the vast and fanatical private aviation community on the World Wide Web. One door showed that there was a second plane, another revealed a second ownership entity, yet another showed that a Steward executive and board member was affiliated with that other company, Management Health Services. Bottom line: Even Steward representatives didn’t push back on the notion that they fund both planes.

The thought did strike me that maybe de la Torre and his executive team were using these planes to embark on critical missions to deliver desperately needed supplies to his chain of woefully under-resourced hospitals. These jets are so sophisticated you can picture an airdrop of medicines and equipment at St. Elizabeth’s Medical Center before they whooshed away to another city and another hospital in need.

So I sought the flight records for these planes to confirm that this was the case. Steward didn’t seem to make this easy, either, but a very accommodating gentleman affiliated with a strikingly informative aviation site, FlightRadar24 , was there to help. Within a day or two, I had a file in my email with every takeoff and landing for each plane in the past two-plus years.

Hmmm. Does Steward have hospitals in Santorini, Corfu, Athens, Naples (Italy, not Florida, but Florida, too), Madrid, Rome, Croatia, and the French Riviera? Or did an eager mariner simply need a ride to his yacht? What about the Bahamas, St. Kitts, Cabo San Lucas, Providenciales, Montego Bay, St. Maarten, and Antigua? And then there were all these flights to Panama and Ecuador, where I recently reported that his superyacht, the Amaral, had been moored. Coincidence?

There is no evidence that de la Torre was on all of these flights, because the planes are apparently available to other executives as well. But seriously, the staffs of Travel & Leisure and the Robb Report don’t spend this much time hurtling toward exotic destinations.

Here, I repeat a sincere and necessary caveat. This is not a screed against wealthy people with mansions and planes and very large boats. But that kind of wealth is supposed to go to those who create something that other people want, not a bunch of scheming private equity partners and executives who dismantle something that so many people need. Hospitals are public trusts.

It’s an interesting question, and not an esoteric one, about when immoral actions spill into illegal ones. Governor Maura Healey used the word “criminal” earlier this week when she excoriated Steward for its management of its nine Massachusetts hospitals, and said she basically wanted them out of the state. There are people who can look at how federal money has been spent and where it’s gone, and hospitals, Steward especially, have federal money coming in every day. Are they?

But back to the unanswered question of why a hospital company like Steward needs a pair of ultra-luxury jets capable of zipping around the world. The painfully obvious answer is, it absolutely doesn’t.

It especially doesn’t need it when hospital staffs are getting cut, when medical equipment is getting repossessed , when so many vendors aren’t getting paid, and when the quality of health care that it delivers is unquestionably diminished because the many great doctors and nurses and technicians in these hospitals lack the staff support they need and sufficient supplies.

And all the while, de la Torre and his private equity friends at Cerberus Capital Management have been living high, sky high in de la Torre’s case, off the money they made when they wrung hundreds of millions of dollars from a hospital system in dire need of resources and care.

Two other quick points. The Global 6000 was acquired by the Steward-related holding companies in 2020. The company that had it before that, which apparently purchased it brand new: Medical Properties Trust, the Alabama-based REIT that bought the land and hospital buildings from Steward, in a series of transactions that allowed a few people to get very rich while leaving Steward with hundreds of millions of dollars in annual rent. It’s hard to know what to make of that.

And Thursday, after I’d been asking about the jets this week, a Steward spokeswoman, Josephine Martin, called to say that the two planes were now for sale. The Falcon, she said, had recently been put on the market. The Global 6000 was listed as of Thursday.

“It’s part of a reset for Steward, selling down assets and working to be a different kind of company,” Martin said.

Maybe that should provide some satisfaction. Still, certain images remain: Chaos on the ground at so many Steward hospitals, state officials trying to prevent a crisis if any of them close, while Ralph de la Torre soars above it all in a plane built for a king. When bills went unpaid and cuts were made on personnel and supplies, there was always plenty of money for the jets.
